Bonczek, City Manager PREPARED BY: Kyle Hayes, Economic Development Director MEETING DATE: October 31, 2000 AGENDA MEMO DATE: October 25, 2000 REQUESTED ACTION: Consider approving the allocation of Community Development Block Grant Funds for the construction of a Habitat for Humanity Re-Store Warehouse. RECOMMENDATION Administration recommends the allocation of Community Development Block Grant funds in the amount of$68,000 for the construction of a Habitat for Humanity Re-Store Warehouse. BACKGROUND On Tuesday, October 17, 2000, representatives from Beaumont Habitat for Humanity made a grant request to the City Council for $68,000 towards the construction of a $150,000 warehouse to be located on Caldwell near M.L.K. Parkway. The projected budget for the warehouse includes $10,000 for land acquisition, $10,000 for clearing and site preparation, $30,000 for labor and insurance and $100,000 for materials. Local vendors, contractors, and individuals would be able to donate overstocked and/or used building materials to the Re-Store. Habitat for Humanity would in return use the building materials to construct affordable housing in Beaumont. Supplies not used by Habitat will be sold at the Re-Store to the general public for pennies on the dollar, allowing especially, low and moderate income families to affordably maintain and repair their homes. The Re-Store projects to employ two full-time employees and three part-time employees. BUDGETARY IMPACT The Administration recommends using Community Development Block Grant funds from the 1999 Program Year. There is approximately $250,000 available in the Senior Multi-Family Housing Development line item. PREVIOUS ACTION None. SUBSEQUENT ACTION None. RECOMMENDATION Administration recommends a raze order because owners failed to comply with previous orders to correct code violations or demolish the structure. BACKGROUND Each of these structures have appeared before City Council in the past and a raze or repair order was issued. The owners failed to comply with correcting code violations or demolishing the structures. BUDGETARY IMPACT City may incur the cost of demolition. PREVIOUS ACTION Previous orders by City Council to raze or repair were not complied with. SUBSEQUENT ACTION Clean Community Department will demolish or cause to be demolished, said structures. RECOMMENDED BY City Manager and Clean Community Department Director. RECOMMENDED MOTION Approve/Deny the authorization to demolish the above listed structures in non-compliance with City codes. ********************************************************************************* REQUESTED ACTION: Council consider after public hearing to declare the following twenty-six (26) structures to be dangerous structures and order the owners to raze said structures within ten (10) days. BACKGROUND It has been determined that these structures meet the definition of a dangerous structure because they have deteriorated such that they are no longer considered suitable for repair. BUDGETARY IMPACT City may incur the cost of demolition. PREVIOUS ACTION These structures have been inspected by the Clean Community Department and found to be dangerous structures as defined by the City of Beaumont's Code of Ordinances, Article III, Dangerous Structures, Section 14-50. SUBSEQUENT ACTION Clean Community Department will demolish or cause to be demolished, said structures. RECOMMENDED BY City Manager and Clean Community Department Director. RECOMMENDED MOTION Approve/Deny the authorization to condemn and raze the above listed dangerous structures. REQUESTED ACTION: Council consider after public hearing a raze or repair order on the following five (5) structures. 32. 2985 Amarillo 35. 258 Hampton Lane (2) 33. 970 Avenue F (2) 36. 3545 Marie 34. 4595 Buffalo (2) (*) Indicates number of times structure has been enrolled in work program. RECOMMENDATION Owner to be issued an order to raze or repair structure within a specified time. Owner must immediately enroll in a work program following Council's specified order of time for compliance. BACKGROUND These structures were inspected and found to be substandard and not meeting City code requirements, but could be rehabilitated. BUDGETARY IMPACT None at this time. PREVIOUS ACTION The above structures were issued notification of being substandard as defined by the City of Beaumont's Code of Ordinances, Article 11.1, Dangerous Structures, Section 14-50. SUBSEQUENT ACTION Staff will enroll owner in a work program and monitor work for allotted time granted by Council. RECOMMENDED BY City Manager and Clean Community Department Director. The roof was replaced but the charred and burnt stripping and supports were not properly removed before putting on the new decking. The fascia boards are charred and will need replacing. The front porch is deteriorated and will need repair. All damaged or rotten windows and window sills will need to be replaced. All missing windows will be needed to be replaced throughout the two-story structure. The exterior doors need to be replaced. The exterior siding is deteriorated and some is missing and will need replacing. All interior flooring, ceilings and walls need to be repaired. All damaged electrical wiring and missing electrical fixtures will need to be replaced. Also, all damaged plumbing or missing plumbing fixtures will need to be replaced. Initial Inspection Date May 7, 1998 MAJOR CODE VIOLATIONS: Staff drove by this structure several times trying to locate Mr.Kirkmon but was unable to find him there Staff has had no contact with Mr.Kirkmon since City Council meeting on August 29,2000 when he was advised to get credible bids,appraisals and financial proof within thirty days Mr.Kirkmon has continued to do some small repairs (replacing siding and some work on the roof)without an active work program. A stop work order was placed on the structure xx-xx-00 Staff continued to monitor the property because Mr.Kirkmon did not respond to the stop work order. Another inspection was made on October 9,2000 and Mr.Kirkmon was found working with two other gentlemen. It was explained once again what he was ordered to do by City Council and he was told to stop working. We discussed the stop work order that had been placed on the building. Mr.Kirkmon stated that he had not seen it so it was again explained what Council had ordered and another stop work order was given to Mr.Kirkmon. It was explained that the time Council had allowed had expired. Mr. Kirkmon showed me a bid sheet on the cost of the roofing that was being done without a work program and permits He requested that staff send his certified notices to 2057 Irving and he also gave me the telephone number of 835-5152 where staff could leave a message. Mr. Kirkmon also informed staff that he was going to demolish the rear residential section of the structure. Contractor may at its discretion engage subcontractors to perform work hereunder,provided Contractor shall fully pay said subcontractor and in all instances remain responsible for the proper completion of this Contract. 5. Contractor shall furnish Owner appropriate releases or waivers of lien for all work performed or materials provided at the time the next periodic payment shall be due. 6. All change orders shall be in writing and signed both by Owner and Contractor, and shall be incorporated in, and become a part of the contract. 7. Contractor warrants it is adequately insured for injury to its employees and others incurring loss or injury as a result of the acts of Contractor or its employees or subcontractors. 8. Contractor shall at its own expense obtain all permits necessary for the work to be performed. 9. Contractor agrees to remove all debris and leave the premises in broom clean condition. 10. In the event Owner shall fail to pay any periodic or installment payment due hereunder, Contractor may cease work without breach pending payment or resolution of any dispute. 11. All disputes hereunder shall be resolved by binding arbitration in accordance with rules of the American Arbitration Association. 12. Initial Inspection Date May 7, 1998 MAJOR CODE VIOLATIONS: Staff drove by this structure several times trying to locate Mr.Kirkmon but was unable to find him there Staff has had no contact with Mr.Kirkmon since City Council meeting on August 29,2000 when he was advised to get credible bids,appraisals and financial proof within thirty days Mr.Kirkmon has continued to do some small repairs (replacing siding and some work on the roof)without an active work program. A stop work order was placed on the structure xx-xx-00 Staff continued to monitor the property because Mr.Kirkmon did not respond to the stop work order. Another inspection was made on October 9,2000 and Mr.Kirkmon was found working with two other gentlemen. It was explained once again what he was ordered to do by City Council and he was told to stop working. We discussed the stop work order that had been placed on the building. Mr.Kirkmon stated that he had not seen it so it was again explained what Council had ordered and another stop work order was given to Mr.Kirkmon. It was explained that the time Council had allowed had expired. Mr. Kirkmon showed me a bid sheet on the cost of the roofing that was being done without a work program and permits He requested that staff send his certified notices to 2057 Irving and he also gave me the telephone number of 835-5152 where staff could leave a message. Mr. Kirkmon also informed staff that he was going to demolish the rear residential section of the structure. Back steps are needed. All damaged or rotten windows and window sills will need to be replaced. Glass in windows have been broken out and screens will also need t o be replaced. The exterior doors need to be replaced. There are holes in the floor and the sheetrock is damaged. All interior flooring, ceilings and walls need to be repaired. Some of the exterior siding is missing and needs to be replaced. All damaged electrical wiring and missing electrical fixtures will need to be replaced. Outside service is needed. Also, all damaged plumbing or missing plumbing fixtures will need to be replaced. The structure is open and accessible and being severely vandalized and stripped. There has been complaints of illegal activity. There is a garage in the rear that is about to collapse. This structure appeared before City Council on April 28, 1998 and again on July 7, 1998. A raze or repair order was issued each time and the property owner has not complied with that order.
