REQUESTED ACTION: Council consider a resolution authorizing the award of a contract
for construction on Concord Road Pavement Widening Project,
Phase I11, including Travis Drive.
RECOMMENDATION
Administration recommends approval and execution of a contract with Allco, Inc. in the amount
of$5,538,569.25 for the Concord Road Pavement Widening Project, Phase III, including Travis
Drive. The MBE requirements will be met through sub-contracts with certified MBE firms of
Crabtree Barricades, Hollis Trucking, CMM Construction and Texas Mechanical for a total of
$561,120. This amount represents 10% of the total bid.
Administration recommends authorization to award this contract.
BACKGROUND
On November 6, 2000 the City of Beaumont received six (6) bids for Concord Road Pavement
Widening Project, Phase III, including Travis Drive. The lowest bid was submitted by Allco, Inc.
in the amount of $5,538,569.25. The list below identifies the total bids received from each
contractor:

BUDGETARY IMPACT
The engineer's estimated cost of the project prior to the receipt of the bids was $5,500,000 and
the funds are available in the Capital Improvement Funds.

REQUESTED ACTION: Consider changes to Section 29-72 (B) (2) and (B)(3)(b) of
the City Ordinances regarding tow truck and towing
companies, amending Ordinance 98-64.
RECOMMENDATION
The Administration recommends approval of amendments to Section 29-72, ordinances of the
City of Beaumont, regarding the requirement that towing companies operate vehicle storage
facilities in the City and allowing multiple companies to operate from the same location if they
are currently licensed and certified by the state and operating within the city.
BACKGROUND
On February 9, 1988,the City Council adopted Ordinance 88-15 re-enacting provisions of the
City Code in Article IV Wreckers. Section 29-75 of that article stated, in part, as follows:
"Locations Requirements. The wrecker company shall not be a part of another business that
performs wrecker service as a part of that business. The wrecker company shall not be located at
the same physical location as another wrecker company. "
On October 6, 1998, the City Council amended the wrecker ordinance by adopting Ordinance 98-
64 creating a new Article IV titled Tow Trucks, Towing Companies, and Tow Truck Operators.
Section 29-72 (B) states standards regarding vehicle storage facilities and physical locations
under this new ordinance. Those requirements include:
(2) the towing company operates a vehicle storage facility in the City of Beaumont which
is, at all times, licence pursuant to the Texas Vehicle Storage Act, as it may be amended,
and which is in compliance with all provisions of the Texas Vehicle Storage Facility Act
and any other provisions of the Texas Administrative Code relevant to operation of a
vehicle storage facility".
(3)(b) The physical facility to be operated by the towing company is not a part of any
other business which performs towing services and is not located at the same physical
location as any other towing company.
Walls Wrecker Service and S & S Wrecker, Inc. had been operating from the same physical
location at 1275 W. Cardinal Drive. The City has apparently taken no action to enforce the
premises location requirements set forth in either Ordinance 88-15 or 98-64 in regard to both
wrecker services being located at the same address, 1275 W. Cardinal Drive. Neither of the two
ordinances contain"grandfather"provisions which would have lawfully allowed the two
business to operate at the same location. Additionally, S & S Wrecker, Inc. has not complied
with city ordinance in regard to having a licensed vehicle storage facility as required under
Section 29-72 (B)(2).
Both businesses have been advised that their lease at 1275 W. Cardinal Drive is ending at the end
of December. 2000. Accordlmdy, am,claim to any"grandfather" proti isions allowing them to
operate at the same location would cease.
The two wrecker companies have requested that the ordinance sections noted herein be modified
to allow both companies to operate at a single new business location and also not require,by
ordinance, that wrecker companies operate state licensed vehicle storage facilities.
The tow truck-wrecker ordinances of approximately nineteen cities in the State of Texas were
reviewed in regard to requirements as to operation of vehicle storage facilities and operating at
the same business locations. The ordinances of several cities do not specifically address the issue
of multiple wrecker businesses operating at the same location or the requirement that Iicensed
wrecker operate vehicle storage facilities. In many cases, non consent/emergency tows involve
vehicles being taken to city operated storage facilities, those facilities often being operated on a
contract basis with the city. Additionally, many cities contract with specific towing companies
to provide emergency/police initiated tows for the cities. At least eight of the city ordinances
reviewed provide that the city operate a contract storage lot for police initiated tows.
Of the cities reviewed, Corpus Christi and Port Arthur both have requirements similar to
Beaumont's in regard to one company per business location.
Examples of ordinances addressing vehicle storage vehicles include Austin's which requires that
individuals having a tow truck license must own or have contracts with licensed storage lots,
Galveston which requires that tows go to approved storage lots used by the towing company,
Laredo which requires tows going to storage lots of the company doing the tow, and Port Arthur
which requires the tow company to own or lease a licensed storage lot.
The police chief is concerned with any amendments to the Ordinance that may impact on the
ability of police officers and/or citizens to investigate claims of misconduct and to assess
responsibility for acts of misconduct under the ordinance. The Police Administration will be
doing a comprehensive review of this ordinance to determine any needed revisions. There will
be a meeting scheduled with tow companies in Beaumont to solicit their input and suggestions.
The results will be present to Council at a future worksession.

PREVIOUS ACTION
Ordinance 88-15 adopted February 9, 1988 re-enacted provisions of the City Code in Article IV-
Wreckers and Ordinance 98-64 created a new Article IV titled Tow Trucks, Towing Companies,
and Tow Truck Operators.

BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1.
That Chapter 29 of the Code of Ordinances of the City of Beaumont be and the
same is hereby amended to add a new section 29-72(f) to read as follows:
29-72(f) Notwithstanding the provisions of this ordinance to the contrary, towing
companies who were sharing vehicle storage facilities at business locations on January
1, 2000 may continue to share vehicle storage facilities in business locations.
Section 2.
That if any section, subsection, sentence, clause or phrase of this ordinance, or the
application of same to a particular set of persons or circumstances should for any reason
be held to be invalid, such invalidity shall not affect the remaining portions of this
ordinance, and to such end the various portions and provisions of this ordinance are
declared to be severable.
Section 3.
All ordinances or part of ordinances in conflict herewith are repealed to the extent
of the conflict only.

Dear Council Mcmbers:
Sunlight Baptist Church has the desire to construct a senior citizen's lc, v income complex in a
four square block section of Beaumont bordered by ivILK Blvd. And ('.:dar Street. This project is
a 66 unit complex costing approximately 2.7 million.
In order to accomplish this project, Sunlight Baptist Church has contacted HUD in Houston and
received a favorable response. HUD has expressed considerable interest in doing a project in the
Beaumont area HUD, also, introduced us to the community development person at Wells Fargo in
Houston, Texas. Wells Fargo has expressed interest in the project with HUD. They will process
the loan through their branch banks in the Beaumont area.
Both entities were impressed with the fact that the City of Beaumont had considered investing
$350,000 in the project.
This project has been in the making for a long time. The opportunity for the investment of the
City of Beaumont has passed. We are asking for the City to re-establish the commitment to the
project.

service due to age and deterioration. Funds are available for this expenditure in the Capital

Administration recommends approval of a contract with BUILD, Inc., Beaumont Main Street to
further economic growth in downtown Beaumont. The annual contribution from the City will be
matched with other local funds and used to promote downtown business development and

F) Authorize the acquisition of property for the Charlton-Pollard Park and

Property located at 2125 St. Anthony Street would be acquired from Eleanor Louise Boswell

The claim of Margaret Jones would be settled in the amount of$6,800. There are sufficient

Association
Administration recommends approval to renew a five-year lease with The Neches Valley
Producers Association,beginning January 1, 2001 and expiring December 31, 2005. The lease
area, known as "Farmers Market," is a 2.72 acre site out of the James Drake Survey and located
at 2095 St. Helena Street. The property has been leased by the Association since 1961 and has
been utilized as a public market for the sale of produce. A copy of the staff memorandum is

BACKGROUND
The belt filter press specified in the bid will be installed at the Water Reclamation Plant to process
and dispose of biosolids. The biosolids are mixed with a polymer and processed through the belt
filter press. The press carries the mixture along a conveyor belt, dewatering the biosolids by
applying pressure between a series of rollers and belts. The resulting dried solids are loaded via
conveyor belt into trucks for proper disposal. The plant processes over 3,000 metric tons of
biosolids annually.
This unit is to be used in tandem with a similar unit purchased in April, 2000. The system is
designed to utilize two (2) presses in order to more efficiently handle the load, and to minimize
wear on the machines.

This agreement is made and entered into by and between the City of Beaumont,
Texas, a municipal corporation of the State of Texas, hereinafter called "City", acting
herein by and through its duly authorized City Manager, and BUILD, Inc., a non-profit
corporation, hereinafter called "BUILD", acting herein by and through its President.
WHEREAS, the City believes that economic development and downtown
revitalization are crucial to the continued economic success of City and believes that
BUILD should be retained to carry cut a program Of w:. : on behalf of City to accomplish
these goals;
NOW, THEREFORE, in consideration of the mutual promises made herein, the City
and BUILD agree as follows:
STATEMENT OF WORK
City does hereby enter into a contract with BUILD to provide a comprehensive
range of plans and projects in Beaumont directed at economic development and downtown
revitalization by:
a) promoting the physical and social development, redevelopment and
economic well being of downtown Beaumont;
b) creating an environment in the downtown area which is conducive to
residential, commercial, employment, recreational and cultural-artistic revitalization;
c) attracting new employers;

program between BUILD and the Texas Historical Commission as presented in Attachment

COMPENSATION
City hereby agrees to pay to BUILD during the term of this agreement Twenty-five
Thousand Dollars ($25,000.00) from the City's General Fund. BUILD agrees to raise at
least Twenty-Five Thousand ($25,000.00) in additional funding from the private sector to
match the City's financial commitment.
DISBURSEMENT
Payment to BUILD will be made on a reimbursement basis and those payments will
be supported by proper verifiable documentation.
RECORDS AND REPORTS
Quarterly progress reports detailing the activities and accomplishments of BUILD,
emphasizing compliance with the Urban Main Street Program, will be due thirty (30) days
following the end of the quarter beginning with the quarter ending March 31, 2001. In
addition to said quarterly reports, BUILD will also provide an annual review related
specifically to the Urban Main Street Program covering the period of this agreement due
on January 31, 2002.
SUSPENSION AND TERMINATION
The term of this agreement will be January 1, 2001, through December 31, 2001.
Suspension and/or termination may occur if BUILD fails to comply with any or all provisions
of this agreement or for convenience.

WHEREAS, Adelphia Business Solutions of Texas (herein "ABS") desires to use certain
public right-of-way within the City of Beaumont for the purposes set forth below; and,
WHEREAS, it is the position of the City of Beaumont that ABS must obtain a license in
order to use the public right-of-way; and,

The City of Beaumont, hereinafter called "City" for and in consideration of the receipt of
good and valuable consideration,as set out more fully herein,hereby agrees with ABS that ABS may
lay, maintain, operate,replace or remove a fiber optic communication system (the"system") for the
transportation of communications in, on, under or across the streets, alleyways and easements set
forth in Exhibit "A" and situated in the City of Beaumont, Jefferson County, Texas, as more
specifically set out herein and subject to the following conditions:
(a) The system shall be installed in such a manner as has been approved by the
City Engineer and/or the Texas Department of Transportation, if applicable,
so that the finished installation shall, in no way, interfere with the use of the
public streets and alleys by the public. Pen-nits shall be obtained by ABS or
ABS contractor from the Public Works Department of the City prior to any
installation,maintenance or removal requiring excavation.
(b) The system shall be buried at a depth of no less than thirty(30)inches unless
otherwise authorized by the City Engineer and/or the Texas Department of
Transportation, if applicable. The system is to be installed a minimum of

thirty-six inches (36")below the existing flow line of the adjacent drainage
ditch, when crossing or placed in said ditch. ABS will notify the Public
Works Department of the City of Beaumont prior to installation of the system
under this agreement, and shall obtain City permits at no cost.
(c) The installation and operation of the system shall not interfere with the
natural drainage in that area nor with the drainage system of the City, nor
with sanitary sewer lines, water lines, or other facilities.
(d) All excavations within the right-of-way shall be backfilled in accordance with
City Standards. All surplus material shall be removed from the right-of-way.
(e) Excavations necessary for the installation, repair or maintenance of the
system shall be performed in such a manner as will cause the least
inconvenience to the public and ABS shall promptly restore to as good a

and/or the Texas Department of Transponation, all streets, alleys, or
easements, excavated by it.
(f) The system will be installed in accordance with the drawings approved by the
City and to the specifications which set out the specific location, depth,
method of construction, etc., of the installation.
(g) Construction along roadways shall be performed in such a manner that
excavated materials shall create the minimum hazard and obstruction. All
property where operations are performed will be restored to original
condition or better. The cost of any repairs to road surface, roadbed,
structures or other right-of-way features as a result of this installation will be
borne by the owner of the system.
(h) Any installation which takes place in, on, under, above, or across property
which is not owned by the City or not a City easement or right-of-way shall
require additional permission by the owner(s) of the property involved.
Approval of this license agreement excludes permission to do any installation
on property which is not owned by the Cite of Beaumont.
(i) Barricades,warning signs, lights, and flagmen will be provided and installed
in accordance with the Texas Manual of Uniform Traffic Control Devices
(current edition) by ABS contractor when, in the opinion of the City
Engineers, such is necessary for the safe installation of the system. ABS or
its contractor will provide supervision of the work which is knowledgeable
in the standards referred to above. Nothing herein is to be construed as
prohibiting the use by ABS or its contractor of additional barricades,warning

signs and lights or flagmen as be necessary. In the event ABS or its
contractor does not comply with the barricading standards, the City Engineer
may order ABS and its contractor to stop work; but only until compliance is
achieved.
(j) City reserves the right to lay and to permit to be laid sewer, gas, water and
other pipes and cables, and to do or permit to be done any municipal
underground work that may be deemed to be necessary or proper by City in,
across,along,or under any of the streets, alleys and easements, and to change
any curb or sidewalk or the grade of any of said streets. In doing or
permitting any such work, the City of Beaumont shall not be liable to ABS
for any damage occasioned; it being understood that nothing herein shall be
construed as foreclosing ABS rights to recover damages against any
contractor or third party who may be responsible for damages to ABS
facilities.
(k) If the City requires ABS to remove, alter, change, adapt, or conform its
facilities because of changes in the grade of a street or in the location or
manner of constructing a water pipe, sewer pipe, or other underground or
above ground structure owned by the City, on alternative right-of-way
provided by the City, ABS shall make the alterations or changes as"soon as
practicable when ordered in writing by the City, without claim for
reimbursement or damages against the City at no additional charge to ABS.
If these requirements impose a financial hardship on ABS, ABS shall have
the right to present alternative proposals for the City's consideration. If the
City requires ABS to remove, alter, change, adapt or conform its facilities to
enable any other corporation or person, except the City,to use, or to use with
greater convenience, any public right-of-way, ABS shall not be required to
make any such changes until such other corporation or person shall have
undertaken, with solvent bond, to reimburse ABS for any loss and expense
which will be caused by or arise out of such removal, alteration, change,
adaptation or conformance of ABS facilities; provided, however, the City
shall never be liable for such reimbursements.
(1) ABS shall indemnify, save and hold harmless the City of Beaumont from any
and all claims for injuries and damages to persons or property occasioned by
or arising out of the installation, maintenance, operation, repair or removal
of the system by ABS,except to the extent arising from the sole negligence,
or wanton conduct or gross negligence of the City of Beaumont, its
employees or agents. Neither party shall be liable to the other for any
consequential, special, or indirect damages hereunder.

(m) If the system or any part thereof installed by ABS shall be in any respect
damaged or injured by the City or any public entity in connection with any
construction or maintenance of any public facility, ABS shall not be entitled
to prosecute or maintain a claim against the City or such public agency unless
such damage is occasioned by the City or such public agency or wanton
conduct or gross negligence. However, nothing contained in this paragraph
shall prevent ABS from prosecuting or maintaining a claim against a private
contractor employed by the City or such entity.
(n) Recovery by ABS for damages that occur to ABS facilities, as a result of
an adjoining residential homeowner's attempt to construct improvements to
his frontage shall be limited to actual damages only and no loss of revenue
as damages. Any additional cost shall be borne by ABS.
(o) The system shall be maintained and operated in such a manner as to cause no
maintenance and operation shall be at ABS expense. Such damages shall be
limited to actual damages and no loss of revenue damages.
(p) ABS contractors shall furnish the City with a certificate of insurance issued
by an insurer acceptable to the City showing that the permittee has in force,
and will maintain in force during the construction of the system, liability
insurance of not less than $1,000,000 for any one accident and property
damage insurance of not less than$1,000,000,or to applicable City insurance
requirements, at the time of such construction. Such insurance shall be
maintained in force during the life of the project and no modifications or
change of insurance coverage and provisions shall be made without ten(10)
days written advance notice to the City.
(q) ABS agrees that it shall mark the location of its system within forty-eight
(48) hours after receipt of notification of proposed construction. ABS
maintain a toll-free telephone number to be called for location of the system.
Should ABS fail to locate the system for the City within forty-eight (48)
hours of request duly acknowledged, ABS shall pay a late charge of Five
Hundred Dollars (5500) per day. In the event of a dispute concerning notice,
ABS audio tape of telephone messages shall provide proof of notification
which tapes will be made available upon request. Alternatively,notice may
be shown by delivery of a certified letter to ABS .
(r) ABS, at no cost to the City, shall keep in the City and make available upon
request,complete"as built"drawings clearly showing locations and depth of
all facilities. Such drawings shall be provided by the City within sixty(60)
days after completion of the project.

(s) "With the exception as set out herein,this agreement is personal to ABS and
may not be assigned to any other company or legal entity without written
approval by the City of Beaumont, Beaumont Public Works' Director.
However, any assignment or transfer or sale to a company owned, managed
or controlled by ABS, any of its affiliates, parents, subsidiaries, John J.
Rigas, or any member of his immediate family, shall not require the consent
of the City of Beaumont. Should ABS contemplate any assignment or
transfer of the rights under this agreement, whether with the approval or
without the approval of the City of Beaumont, notice of the proposed
assignment or transfer shall be given to the City of Beaumont thirty(30)days
prior to any such assignment. Such notice shall provide information
sufficient for the City to determine whether the assignment requires the
approval of the City of Beaumont or does not require such approval."

terminated upon said sixtieth day. Any notice to be given hereunder by either party to the other may

The above-stated addresses may be changed to such addresses as the parties may from time to
time designate by written notice. ABS will provide City with a toll free telephone number to be
used pursuant to Paragraph "q" above within 15 days of completion of installation of the line(s)
contemplated by this agreement. If such telephone number is not furnished ABS will bear all
responsibility should such lines be severed.

Commencement of work on the fiber optic system by ABS after the date of this agreement
shall be construed as evidence of ABS acceptance and approval of the conditions above set forth.
This agreement shall be governed by and construed in accordance with the laws of the State
of Texas.
This agreement embodies the entire agreement between the parties hereto and supersedes all
prior agreements and understandings, if any, relating to the matters addressed herein. This
agreement may be amended or supplemented only by a written instrument executed by both parties.

RECOMMENDATION
Administration recommends approval to renew a five (5) year lease with The Neches Valley
Producers Association, beginning January 1, 2001 and expiring December 31, 2005.
BACKGROUND
The lease area, known as "Farmers Market," is a 2.72 acre site out of the James Drake Survey
and located at 2095 St. Helena Street. The property has been leased by the Association since 1961
and has been utilized as a public market for the sale of produce.
The current lease was executed January 16, 1996 and provides for the period of January 1, 1996
through December 31, 2000.
The lease agreement requires that the Lessee maintain the improvements, parking area, and
remaining property for the entire lease period, at Lessee's sole expense. The agreement also
stipulates that only members of its Association residing in the Counties of Chambers, Galveston,
Hardin, Jasper, Jefferson, Liberty, Newton, Angelina, Orange, Polk, Tyler, Sabine, and San
Augustine be permitted to sell in this market, except in a product scarcity situation.
All provisions of the renewed lease agreement shall remain the same as the current agreement.
The provisions include an insurance policy requirement of$500,000 comprehensive general

liability, and a sixty (60) day cancellation by either Party. The consideration for the leased
premises remains an advance payment of Five Dollars ($5.00) for the five (5) year term.

for use of the property for a five (5) year term.

use.
4.
PARTIES UTILIZING PREMISES

5.
MAINTENANCE OF PROPERTY
Lessee shall be responsible for the maintenance of the leased premises and agrees to
keep all improvements placed thereon in good repair and in clean condition, and agrees to keep the
parking area clean and property surfaced at all times. Lessee shall be responsible for the conduct
of each member of the Association and the public while on said premises and will insist on each
member observing all the ordinances ofthe City ofBeaumont and the laws of the State of Texas,and

upon their failure to do so,will revoke their rights under this lease. Lessee agrees to pay all charges
for water, gas, electric power, and other utilities incurred during the term hereof, and at the
expiration of this lease, Lessee shall deliver the premises described herein to Lessor in a clean
condition and cleared of all buildings,foundations,rubbish,etc.,unless Lessee and Lessor mutually
agree to renew this lease agreement upon expiration thereof.
6.
IMPROVEMENTS
It is agreed and understood that Lessee shall have the right to place on said leased
prenn1ses such improvements as are reasonably necessary.said improvements to be the responsibility
of Lessee.
7.
LIABILITY
Lessee shall indemnify and hold Lessor harmless from any and all liabilities,claims,
damages, judgments, injuries, costs, and expenses, including reasonable attorney's fees for the
defense thereof,arising from the conduct or management of Lessee's business or its use of the leased
premises.
8.
INSURANCE COVERAGE
Lessee shall carry a policy of comprehensive general liability insurance with a
company acceptable to Lessor, naming the Lessor as an additional insured in the sum of Five
Hundred Thousand Dollars ($500,000.00) combined single limit during the entire term of the
contract. The original certificate of insurance shall be filed with the City Clerk of the City of
Beaumont,prior to Lessee's taking possession of the described premises under this lease.

9.
CANCELLATION
It is mutually agreed and understood between the parties hereto that either party to
this lease shall have the right to cancel same for any reason whatsoever by giving the other party
notice in writing of its intention to cancel at least sixty (60) days prior to the effective date of
cancellation. It is understood, however,that Lessor will not give notice of cancellation so that the
time of cancellation will occur during the months of June,July,or August,which is heavy marketing
season of said Association. Upon notice of cancellation by Lessor or at termination of lease in any
other manner.Lessee agrees to remove all improvements within forty(40)days or same will become
the property of Lessor at its option.
10.
RIGHT TO ENTER PREMISES
It is understood between the parties hereto that Lessor reserves the right at any and
all times to enter said premises or any part thereof for the purpose of constructing, reconstructing,
or maintaining the drainage ditches or drainage structures located on the leased premises.
11.
EXPIRATION OF LEASE
Should Lessee hold over the premises,or any part thereof,after the expiration of the
term of this lease, unless otherwise agreed in writing, such holding over shall constitute and be
construed as tenancy from month-to-month only. Inclusion of the preceding sentence shall not be
construed as Lessor's consent for Lessee to hold over.

Administration recommends approval of a resolution adopting guidelines for the incorporation
of storm water quality control measures for new development and redevelopment within the
City of Beaumont.
BACKGROUND
In 1990 the U.S. Congress passed the Clean Water Act (CWA) which, with subsequent
amendments, established the National Pollution Discharge Elimination System (NPDES) which
requires cities having populations greater than 100,000 people to obtain a permit to discharge
storm water collected by the city's storm sewer system into "public waters". In compliance
with the provisions of this legislation the City of Beaumont and Jefferson County Drainage
District No. 6 (DD6) applied for and, effective October 1, 1998, were issued by USEPA, a
permit for the discharge of storm water to the Neches River and Hillebrandt Bayou.
The NPDES Storm Water Permit requires the City to, "Submit certification of the formal
adoption of post-construction water quality standards and practices for development and
redevelopment projects (BMP A2-4, item e)".

water pollution impacts; localized and/or on-site treatment measures; drainage
management for pollution control purposes; and nonstorm water discharge control.

process of the project.
g) Encourage and promote effective storm water pollution controls in constructed
projects, either in initial development or redevelopment, by enhancing awareness
of developers, commercial facility owners, and professionals in construction
related activities of the need, value, and opportunities for inclusion of effective
storm water pollution controls in constructed projects, whether in initial project
development or redevelopment (see Associated Education, Training, or Public
Awareness Programs below).
h) Prepare and make available to private developers and contractors guidance on
planning and zoning requirements and recommendations for develop-
ment/redevelopment to be used to guide city planning, review and/or approval of
proposed projects, and requirements and recommendations for construction of
development/redevelopment projects for the purpose of storm water pollution
control (see Associated Education, Training, or Public Awareness Programs
below).
i) Identify permittee employees who because of job responsibilities require training
in review of storm water pollution co=ol practices for develop-
ment/redevelopment projects.
j) Prepare and provide guidance for permitted employees involved in the review of
development/redevelopment projects in the use of best management practices for
such type of projects.
k) Train permittee employees involved in approval of development/redevelopment
projects in the use of best marggement practices to control storm water pollution
in development/redevelopment projects and the permittees' requirements for such
of projects for storm water pollution control capabilities and conformance to

required or recommended standards, guidance, and practices, such training to be
offered such that current affected employees receiving training by the imple-
mentation date of this program and that new or newly promoted employees
requiring such training receive the training within six months of their hire or
promotion.
1) Annually report upon training and awareness activities; and number of develop-

for the constructed project was provided.

For the Incorporation of
Storm Water Quality Control Measures
In New and Redevelopment
Within the City of Beaumont
June 27, 2000
Introduction
The Environmental Protection Agency(EPA), as a part of the Clean Water Act, has implemented
regulations requiring medium to large cities (population> 100,000)to acquire National Pollutant
Discharge Elimination System (NPDES)permits for storm water discharge. This regulation can
be found in the Code of Federal Regulations, in part 122 of Title 40. The regulations require
owners of municipal separate storm sewer systems(MS4's)within qualifying cities implement a
Storm Water Management Program (SWMP)that incorporates storm water quality measures
referred to as Best Management Practices (BMP's). These BMP's describe the City's
responsibilities and activities related to improving the quality of storm water discharge through
the management of a variety of issues. One of these issues is the impacts of development and
redevelopment on storm water quality. Therefore, in response to these federal mandates the City
has drafted these guidelines and criteria for incorporation into the design and construction of new
development and redevelopment projects. These guidelines are intended for developers,engineers
and architects to assist in the selection of storm water quality control structures and measures
during the initial design stage of any development project within the City of Beaumont Municipal
Development Projects
For the purposes of this guidance, development projects are those that involve highway
construction, road construction, subdivision and land developments, commercial land
development or any other project by which non-residential or non-commercial property is being
developed for residential or commercial use.
Redevelopment Projects
For the purposes of this guidance,redevelopment projects are those projects that involve large
scale improvements to existing developments. Highway widening and road and drainage
reconstruction in commercial or residential areas are examples of redevelopment.
Overview of Issues
The focus of this document is to describe storm water quality control measures to be incorporated
into the design and planning stages of new development and redevelopment projects. This
guidance addresses the following issues:
• Storm water quality control structures for development areas
o Perimeter vegetation
o Sediment Basins
o Grassy Swales
o Oil & Grease Traps
o Permeable Surfaces&Vegetation
• Indirect Connection of Roof Drainage to the Storm Water Drainage System

Purpose
These guidelines are intended to encourage the incorporation of environmentally friendly
structures and best management practices into the design of development and redevelopment
projects. The following control measures and practices are suggested to reduce storm water
pollution. It is a requirement that these guidelines be read and considered by engineers or
architects involved with the design of development and redevelopment projects within the City of
Beaumont Municipal Limits. These guidelines are intended to identify the normal use or purpose
of a variety of control structures and control measures. The engineer or architect will be
responsible for determining the proper use, installation or other details associated with the
incorporation of any of the control measures included in this guidance.
Storm Water Quality Control Structures for Parking Areas and other Paved Areas

potentially erode should be covered with some form of landscaping or grassy vegetation
sufficient to inhibit potential erosion. Landscaping with maintained shrubs will serve as natural
barriers to liter and or trash blowing or floating into storm water ditches and conveyances.
Sediment Basins
The use of sediment basins for large parking areas may be necessary to reduce the flow rate of
rapid runoff. These sediment basins, otherwise referred to as detention basins, are useful flood
control structures generally incorporated to reduce flow velocities in order to prevent downstream
erosion and flooding. Detention basins and/or sediment basins should be incorporated by drainage
experts to prevent downstream flow timing problems and/or localized flooding downstream.
Runoff detained in basins removes harmful sediments from storm water that will eventually enter
streams and rivers.
Grassy Swales
Grassy Swales are used to route storm water to conveyances and prevent sheet flow of storm
water over highly erosive soils. These control structures should be strategically placed to disrupt
and redirect heavy storm water flows from parking areas or other paved areas. These control
structures reduce erosion and provide filtration of raw storm water containing sediment and other
particulate materials.
Oil and Grease Traps
These structures separate oil and grease from storm water based on density differential. These
structures should be incorporated in parking areas and/or paved areas that will likely have
exposure to automotive fluids, repair shop runoff,restaurant grease and cooking oil from kitchens
or any other frequent source of oil and grease.These structures prevent oil and grease from
entering the storm water drainage system and,ultimately,public waters.
Permeable Surfaces and Vegetation
The selective use of native vegetation or permeable surface areas reduces the impact of
impervious surface areas such as parking lots,roofs and other high runoff coefficient surfaces.
The use of vegetation or other more permeable surfaces should be maximized.

Indirect Connection of Roof Drainage to the Storm Water Drainage System

recommended that roof drainage be directed through landscaped areas or to open grassy areas
where feasible.This practice will buffer sediment transport from paved areas.
Permanent Storm Water Quality Control Structures for Development Projects
Control of Dumpster drainage and overflow
All dumpsters, large trash compactors or trash bailing devices should be fully enclosed with
fencing sufficient to inhibit wind transport of overflow trash from these areas. The drainage of
liquids from these areas should be directed into the sanitary sewer where possible. The design
should incorporate mechanisms to accomplish these goals.
Landscape Rule - Zoning Ordinance 30.31
The design of new parking areas within new development or redeveloped areas should include the
minimum grassy areas or buffer strips as described in the City of Beaumont Zoning Code part
30.31.
