ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS, AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS, BY CHANGING THE ZONING OF PROPERTY PRESENTLY ZONED A-R (AGRICULTURAL RESIDENTIAL) DISTRICT TO GC-MD (GENERAL COMMERCIAL-MULTIPLE FAMILY DWELLING) DISTRICT, LOCATED ALONG THE WEST SIDE OF IH-10 AT BROOKS ROAD, BEAUMONT, JEFFERSON COUNTY, TEXAS; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. That Chapter 30 of the Code of Ordinances of Beaumont, Texas, and in particular the boundaries of the zoning districts, as indicated upon the Zoning Map of the City of Beaumont, referred to in Section 30-56 thereof, are hereby amended by changing the zoning of property presently zoned as A-R (Agricultural-Residential) District to GC-MD (General Commercial-Multiple Family Dwelling) District located along the west side of IH- 10 at Brooks Road, described as follows: Legal Description: Tract I BEING a 21.57 acre tract of land consisting of that certain called 21.57 acre tract of land conveyed to Patrick Henry Phelan and Michael Arthur Phelan in Film Code 105-13-0764 of the Official Public Records of Jefferson County, Texas. Said 21.57 acre tract being situated in the Samuel Stivers League, Abstract No. 51, Jefferson County, Texas and is more particularly described as follows: BEGINNING at the intersection of the South line of Brooks Road right-of-way and the Southeast line of that certain Jefferson County Drainage District No. 6 drainage ditch (Amelia Cut-Off) right-of-way (250 feet wide), more fully described and recorded in Volume 1584, Page 250 of the Deed Records of Jefferson County, Texas; THENCE South 69 deg. 04 min. 00 sec. East along and with the South line of said Brooks Road a distance of 99.94 feet to a point at the West end of the Brooks Road overpass right-of-way; THENCE in a Southeasterly direction along and with the South line of said Brooks Road overpass right-of-way the following courses and distances: South 18 deg. 26 min. 08 sec. East a distance of 79.84 feet to a point; South 19 deg. 29 min. 22 sec. West a distance of 69.32 feet to a point; South 24 deg. 30 min. 28 sec. East a distance of 91.31 feet to a point; South 69 deg. 33 min. 01 sec. East a distance of 69.98 feet to a point; South 41 deg. 50 min. 22 sec. East a distance of 206.24 feet to a point; South 13 deg. 50 min. 52 sec. West a distance of 205.04 feet to a point in the Northwest line of Interstate Highway No. 10 right-of-way; THENCE South 41 deg. 37 min. 48 sec. West along and with the Northwest line of said Interstate Highway No. 10 right-of-way a distance of 1594.25 feet to a point in the North line of said Drainage District No. 6 drainage ditch (Amelia Cut-Off) right- of-way; THENCE North 59 deg. 17 min. 12 sec. West along and with the North line of said Drainage District No. 6 drainage ditch (Amelia Cut-Off) a distance of 509.73 feet to a point; THENCE in a Northeasterly direction along and with the Southeast line of said Drainage District No. 6 drainage ditch (Amelia Cut-Off) the following courses and distances: North 41 deg. 37 min. 48 sec. East a distance of 1622.42 feet to a point; North 20 deg. 23 min. 11 sec. East a distance of 375.41 feet to the PLACE OF BEGINNING, containing 21.57 acres of land, more or less. Legal Description: Tract II BEING a 85.45 acre tract of land out of and a part of that certain Patrick Henry Phelan and Michael Arthur Phelan 126.01 acre tract of land, more fully described and recorded in Film code 105-13-0764 of the Official Public Records of Jefferson County, Texas. Said 86.41 acre tract being situated in the Samuel Stivers League, Abstract No. 51, Jefferson County, Texas and is more particularly described as follows: BEGINNING at the Northwest corner of said Phelan 126.01 acre tract, same being the Southwest comer of the C.E. Smith Subdivision as recorded in Volume 1, Page 58 of the Map Records of Jefferson County, Texas, same being in the Southeast line of that certain Jefferson County Drainage District No. 6 drainage ditch (Amelia Cut-Off) right-of-way (260 feet wide), more fully described and recorded in Volume 1584, Page 250 of the Deed Records of Jefferson County, Texas; THENCE South 88 deg. 29 min. 56 sec. East along and with the North line of said Phelan 126.01 acre tract a distance of 1858.08 feet to the Southeast corner of Lot 8 of said C. E. Smith Subdivision; THENCE South 01 deg. 30 min. 04 sec. West a distance of 1446.80 feet to a point in the Northwest line of Interstate Highway No. 10 right-of-way; THENCE South 41 deg. 37 min. 34 sec. West along and with the Northwest line of said Interstate Highway No. 10 right-of-way a distance of 1796.07 feet to a point in the North line of the West end of the Brooks Road overpass right-of-way; THENCE in a Southwesterly direction along and with the North line of said Brooks Road overpass right-of-way the following courses and distances: South 56 deg. 37 min. 47 sec. West a distance of 86.91 feet to a point; North 85 deg. 25 min. 41 sec. West a distance of 87.44 feet to a point; North 69 deg. 43 min. 11 sec. West a distance of 463.98 feet to a point; South 65 deg. 11 min. 50 sec. West a distance of 91.90 feet to a point; South 20 deg. 35 min. 25 sec. West a distance of 64.82 feet to a point; South 60 deg. 11 min. 28 sec. West a distance of 78.66 feet to a point in the North line of Brooks Road right-of-way; THENCE North 69 deg. 04 min. 00 sec. West along and with the North line of said Brooks Road right-of-way a distance of 100.00 feet to a point in the Southeast line of said Drainage District No. 6 drainage ditch (Amelia Cut-Off) right-of-way; THENCE in a Northeasterly direction along and with the Southeast line of said Drainage District No. 6 drainage ditch (Amelia Cut-Off) right-of-way the following courses and distances: North 25 deg. 40 min. 00 sec. East a distance of 257.04 feet to a point; North 01 deg. 18 min. 29 sec. East a distance of 341.90 feet to a point in the South line of that certain Brentwood Investments, Inc. 16.456 acre tract of land, more fully described and recorded as Tract 2 in Clerk's File 9623224 of said Official Public Records; THENCE along and with the boundary of said Brentwood Investments 16.456 acre tract and that certain Brentwood Investments, Inc. 2.835 acre tract of land, more fully described and recorded as Tract 1 in Clerk's File 9623224 of said Official Public Records the following courses and distances: North 61 deg. 50 min. 25 sec. East a distance of 68.11 feet to a point; North 71 deg. 51 min. 06 sec. East a distance of 434.41 feet to a point; North 77 deg. 31 min. 57 sec. East a distance of 820.61 feet to a point North 06 deg. 11 min. 00 sec. East a distance of 775.50 feet to the PLACE OF BEGINNING, containing 85.45 acres of land, more or less, located in Beaumont, Jefferson County, Texas, shown on Exhibit "A" attached hereto, and made a part hereof for all purposes, and the official zoning map of the City of Beaumont is hereby amended to reflect such changes. Section 2. That, in all other respects, the use of the property hereinabove described shall be subject to all of the applicable regulations contained in Chapter 30 of the Code of Ordinances of Beaumont, Texas, as amended. Section 3. That if any section, subsection, sentence, clause of phrase of this ordinance, or the application of same to a particular set of persons or circumstances, should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end, the various portions and provisions of this ordinance are declared to be severable. Section 4. That all ordinances or parts of ordinances in conflict herewith are repealed to the extent of the conflict only. Section 5. That any person who violates any provision of this ordinance shall, upon conviction, be punished, as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas.
