ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF
THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND
IN PARTICULAR THE BOUNDARIES OF THE ZONING
DISTRICTS, AS INDICATED UPON THE ZONING MAP OF
BEAUMONT, TEXAS, BY CHANGING THE ZONING OF
PROPERTY PRESENTLY ZONED RS (RESIDENTIAL
SINGLE FAMILY DWELLING) TO GC-MD-2 (GENERAL
COMMERCIAL-MULTIPLE FAMILY DWELLING-2) DISTRICT
LOCATED AT 622 W. LUCAS DRIVE, BEAUMONT,
JEFFERSON COUNTY, TEXAS; PROVIDING FOR
SEVERABILITY; PROVIDING FOR REPEAL AND
PROVIDING A PENALTY.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1.
That Chapter 30 of the Code of Ordinances of Beaumont, Texas, and in particular
the boundaries of the zoning districts, as indicated upon the Zoning Map of the City of
Beaumont, referred to in Section 30-56 thereof, is hereby amended by changing the
zoning of property presently zoned as RS (Residential Single Family Dwelling) to GC-MD-
2 (General Commercial-Multiple Family Dwelling-2) District located at 622 W. Lucas Drive,
being all that certain tract or parcel of land out of Lots 8, 9, 10, 11, 12, and 13, Block 1 of
the Calder Highlands Addition, recorded in Volume 4, Page 155, of the Map Records
Jefferson County, Texas, and being more particularly described as follows;
Commencing at a 2" iron pipe found for the northwest corner of Lot 13, Block 1;
THENCE East (assumed Basis of Bearings) with the north line of Lot 13, Block 1,
at 120.54 feet the west right-of-way of the new West Lucas Drive and a total
distance of 186.55 feet to a '/2' iron rod set on the east right-of-way of the new West
Lucas Drive for the POINT OF BEGINNING;
THENCE continuing East with the north line of Lot 13, 26.38 feet to a '/z' iron rod
set on the west right-of-way of the original Lucas Drive for the northeast corner of
Lot 13;
THENCE along the arc of curve to the left and the west right-of-way of the original
Lucas Drive 59.57 feet to a %" iron rod set for the point of tangency, and the
southeast corner of Lot 12, said curve having a radius of 1071.14, a central angle
of 030 11' 11" , a chord distance of 59.56 and a chord bearing of South 31 0,17' 06"
East;
THENCE South 300 21' 13" East leaving the original west right-of-way of Lucas
Drive 65.73 feet to a '/2' iron rod set on the north side of a cul-de-sac;
THENCE along the arc of a curve to the left on the cul-de-sac 33.18 feet to a set '/"
iron rod on the west side of said cul-de-sac, said curve having a radius of 45.00
feet, central angle of 420 14' 5", a chord length 32.43 feet, and a chord bearing of
South 100 42' 53" West;
THENCE South 150 03' 40" East crossing the north lines of Lots 10 and 9, 107.07
feet to a '/" iron rod set on the west side of a second cul-de-sac;
THENCE along an arc of a curve to the left on said second cul-de-sac 28.17 feet
to a '/z' iron rod in the north line of a 0.023 acre tract out of Lot 8, recorded under
file No. 9416330 Official Public Records of Jefferson County, said curve having a
radius of 45.00 feet, a central angle of 35° 51' 51" a chord length 27.71 and a chord
bearing of South 31 0 04 '40" East;
THENCE along the north line of said 0.023 acre tract South 880 46' 38" West 67.32
feet to a I" pipe found for the west corner of said 0.023 acre tract in the South line
of Lot 8;
THENCE along the south line of Lot 8, North 770 32' 09" West 100.38 feet to a '/"
iron rod found on the east right-of-way of new West Lucas Drive;
THENCE North 08" 55' 24" East along said east right-of-way of West Lucas Drive
249.41 feet to the POINT OF BEGINNING containing 1.057 acres of land, more or
less, as shown on Exhibit "A" attached hereto and made a part hereof for all
purposes, and the official zoning map of the City of Beaumont is hereby amended
to reflect such changes.
This description is based on a survey and plat made by Donald E. Ogden, Registered
Professional Land Surveyor during January 2000.
Section 2.
That, in all other respects, the use of the property hereinabove described shall be
subject to all of the applicable regulations contained in Chapter 30 of the Code of
Ordinances of Beaumont, Texas, as amended.
Section 3.
That if any section, subsection, sentence, clause or phrase of this ordinance, or the
application of same to a particular set of persons or circumstances, should for any reason
be held to be invalid, such invalidity shall not affect the remaining portions of this
ordinance, and to such end, the various portions and provisions of this ordinance are
declared to be severable.
Section 4.
That all ordinances or parts of ordinances in conflict herewith are repealed to the
extent of the conflict only.
Section 5.
That any person who violates any provision of this ordinance shall, upon conviction,
be punished, as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas.
