ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF
THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND
IN PARTICULAR THE BOUNDARIES OF THE ZONING
DISTRICTS, AS INDICATED UPON THE ZONING MAP OF
BEAUMONT, TEXAS, BY CHANGING THE ZONING OF
PROPERTY PRESENTLY ZONED A-R (AGRICULTURAL-
RESIDENTIAL) DISTRICT TO RM-H (RESIDENTIAL
MULTIPLE FAMILY DWELLING-HIGHEST DENSITY)
DISTRICT FOR A 7.369 ACRE TRACT IN THE 4600 BLOCK
OF N. MAJOR DRIVE (FM 364) IN BEAUMONT, JEFFERSON
COUNTY, TEXAS; PROVIDING FOR SEVERABILITY;
PROVIDING FOR REPEAL AND PROVIDING A PENALTY.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1.
That Chapter 30 of the Code of Ordinances of Beaumont, Texas, and in particular
the boundaries of the zoning districts, as indicated upon the Zoning Map of the City of
Beaumont, referred to in Section 30-513 thereof, are hereby amended by changing the
zoning of property presently zoned as A-R (Agricultural-Residential) District to RM-H
(Residential Multiple Family Dwelling-Highest Density) District for a 7.369 acre tract in the
4600 block of N. Major Drive (FM 364), being that certain 7.369 acre tract out of the D.
Easley League, Abstract 20, Jefferson County, Texas, and being all of Lots 3 and 4 and
a portion of Lot 14 of the Rutledge Homestead Tract, an unrecorded subdivision and being
a portion of those tracts conveyed to John William Binks, Jeff Alexander, and Douglas M.
Barlow as recorded in Clerks File No's 9532450 and 9516454 of the Official Public
Records of Real Property of Jefferson County, Texas, said 7.369 acres being more
particularly described by metes and bounds as follows:

COMMENCING at a 5/8" iron rod found in the north line of a 60 foot road right-of-
way for the southwest corner of said Lot 14;
THENCE North 00 020' 53" East along the common line of Lot 13 of said Rutledge
Homestead Tract and said Lot 14, a distance of 157.20 feet (called North 00 002'
00" East) to a '/z' capped iron rod set for the southwest corner of the said 7.369
acre tract and the POINT OF BEGINNING,
THENCE North 000 20' 53" East continuing along the said common line of Lots 13
and 14, a distance of 196.54 feet (called North 000 02' 00" East) to a 5/8" iron rod
found in the southeast line of an LNVA Canal for the northeast corner of said Lot
13 being the northwest comer of said Lot 14 and the said 7.369 acre tract;
THENCE North 43038' 00" East along the said southeast line of the LNVA Canal,
a distance of 270.23 feet (called North 420 25' 00" East 274.27 feet) to a '/z' capped
iron rod set in the west line of Lot 5 of said Rutledge Homestead Tract for the
northeast corner of said Lot 14 being the most northerly corner of the said 7.369
acre tract;
THENCE South 000 22' 33" West along the said west line of Lot 5, a distance of
74.75 feet (called South 000 02' 00"West 83.72 feet) to a 5/8" iron rod found for the
southwest corner of said Lot 5 being the northwest corner of said Lot 4 and an
interior corner of the said 7.369 acre tract;
THENCE South 890 41' 30" East along the common line of said Lots 4 and 5, a
distance of 840.91 feet (called South 890 41' 30" East, 842.47 feet) to a 5/8" iron
rod found in the west line of North Major Drive (AKA FM 364) for the southeast
comer of said Lot 5 being the northeast comer of said Lot 4 and the said 7.369 acre
tract;

THENCE South 000 06' 40" East along the said west line of North Major Drive (AKA
FM 364), a distance of 314.77 feet (called South 00° 06' 40" East, 314.54 feet) to
a 5/8" iron rod found for the northeast corner of Lot 2 of said Rutledge Homestead
Tract being the southeast comer of said Lot 3 and the said 7.369 acre tract;
THENCE North 890 53' 52" West along the common line of said Lots 2 and 3 at
843.60 feet pass a 5/8" iron rod found in the east line of said Lot 14 for the
northwest corner of said Lot 2 being the southwest corner of said Lot 3 and
continuing in all a total distance of 1028.68 feet (called South 89° 49' 31" West) to
the POINT OF BEGINNING and containing 7.369 acres of land, more or less, and
the official zoning map of the City of Beaumont is hereby amended to reflect such
changes.
Section
That, in all other respects, the use of the property hereinabove described shall be
subject to all of the applicable regulations contained in Chapter 30 of the Code of
Ordinances of Beaumont, Texas, as amended.
Section 3.
That if any section, subsection, sentence, clause of phrase of this ordinance, or the
application of same to a particular set of persons or circumstances, should for any reason
be held to be invalid, such invalidity shall not affect the remaining portions of this
ordinance, and to such end, the various portions and provisions of this ordinance are
declared to be severable.

Section 4.
That all ordinances or parts of ordinances in conflict herewith are repealed to the
extent of the conflict only.
Section 5.
That any person who violates any provision of this ordinance shall, upon conviction,
be punished, as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas.
