BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF BEAUMONT:
WHEREAS, on February 14, 2023, by Resolution No. 23-057, Council approved
the purchase of two (2) trucks for use by Sewer Maintenance; and,
WHEREAS, Rush Truck Center, of Beaumont, Texas, has been unable to
provide the vehicles; and,
WHEREAS, it is in the best interest of the City to cancel the order with Rush
Truck Center, of Beaumont, Texas, and purchase the vehicles from another vendor;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT Council desires to cancel the purchase of the two (2) vehicles in the
amount of $303,333.00 from Rush Truck Center, of Beaumont Texas.
The meeting at which this resolution was approved was in all things conducted in
strict compliance with the Texas Open Meetings Act, Texas Government Code, Chapter
551.

RESOLUTION NO. 23-D57
BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF BEAUMONT:
WHEREAS, on November 2, 2021, City Council approved Resolution No, 21-292
for the purchase of twenty (20) vehicles, and,
WHEREAS, of those vehicles, two (2) Ford 2550 Sewer Maintenance trucks
were included, and,
WHEREAS, after a fifteen (15) month delay Staff has requested to cancel the
purchase of these two (2) items from the vendor, and;
WHEREAS, pricing was obtained from Rush Truck Centers of Texas, of Sealy,
Texas through the H-GAC pricing cooperative contract for two (2) Isuzu NRR Jetter
flush trucks for the Sewer Maintenance Department in the amount of 303,333.00.
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the statements and findings set out in the preamble to this resolution are
hereby, in all things, approved and adopted; and,
THAT the City Council hereby approves the purchase of two (2) NRR Jetter flush
trucks for use in the Sewer Maintenance Department.
BE IT FURTHER RESOLVED THAT the City Manager be and he is hereby
authorized to execute payment in the amount totaling $303,333.00, to Rush Truck
Centers of Texas, of Sealy, Texas for the vehicles listed below as shown on Exhibit "A,"
attached hereto:

1. Two (2) Isuzu NRR Jetter flush trucks which will replace units 3363 and 336,
which will be kept in reserve.
