HomeMy WebLinkAboutRES 23-197RESOLUTION NO. 23-197 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: WHEREAS, the roof at the Beaumont Police Department was severely damaged after a hail storm on April 15, 2023; and, WHEREAS, pricing was obtained by utilizing Buy Board Texas Contract # 581-19 to replace the roof membrane at the Beaumont Police Department located at 255 College Street; and, WHEREAS, Preferred Facilities Group- USA submitted a proposal in the amount of $398,460.88 for the replacement of the roof system at the Beaumont Police Department; and, WHEREAS, City Council is of the opinion that the proposal submitted by Preferred Facilities Group- USA, of Beaumont, Texas in the amount of $398,460.88 should be accepted; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the statements and findings set out in the preamble to this resolution are hereby, in all things, approved, and adopted; and, THAT the City Manager be and he is hereby authorized to accept the proposal and execute a contract with Preferred Facilities Group - USA, of Beaumont, Texas in the amount of $398,460.88 for the replacement of the roof system at the Beaumont Police Department. The meeting at which this resolution was approved was in all things conducted in strict compliance with the Texas Open Meetings Act, Texas Government Code, Chapter 551. The scope of work shall consist of the following: Remove single ply roof membrane and recovery board to existing built-up roof system. Installation of 1/2-inch Dens Deck@ or secure rock over the entire roof surface. Mechanically attached with three-inch disc and No. 14 heavy-duty fasteners to Texas Windstorm Code for perimeter edge, corner, and field fastening pattern. • Install 80 aril fleece back fall adhered with DtirolastO CR20 water -based adhesive applied to Dens ecl . TIME of COMMENCEMENT of COMPLETION The Work to be performed under this Conti -act shall be commenced on the date specified by the Owner ill the Notice to Proceed and the 'work shall be filly completed in 35 working days from the Notice to Proceed date, The Owner and the Contractor recognize that time is of the essence of this Agreement and that the Owner will stiffer financial loss if the Work is not completed within the time specified in this Article 2, herein, plus any extensions thereof allowed in accordance with Article 3 of the Instructions to Bidders. They also recognize the delays, expense, and difficulties involved in proving in a legal proceeding the actual loss suffered by the Owner if the Work is not completed on time. Accordingly, instead of requiring any such proof, the Owner and the Contractor agree that as liquidated damages for delay but not as a penalty) the Contractor shall pay the Owner the stula of $0.00 for each calendar day that expires after the time specified in this Article 2, herein.
