Reed, City Attorney MEETING DATE: September 13, 2022 REQUESTED ACTION: Council consider an ordinance denying Entergy Texas, Inc.'s application to implement Rate Schedule UODG filed with the City on August 31, 2021. BACKGROUND Entergy Texas Inc. ("ETI") filed Entergy Texas, Inc. 's 2022 Statement of Intent to Implement Rate Schedule UODG (Related to Backup Electric Service); PUCT Docket No. 53992 with the Public Utilities Commission of Texas ("PUCT") and the City. The proposed Rate Schedule UODG is a voluntary rate schedule that will apply only to customers who choose to participate in ETI's Power Through service. The Power Through program provides and installs gas-fired generators that range in size from 100 kW to 10 MW to commercial and industrial customer premises. The generators will serve as back-up generators to participating customers during system outages. During normal system operating times, ETI will be able to call on these distributed generation facilities to serve its own system load requirements as back-up to specific customers during system outages. The monthly fee will be site specific and only apply to customers participating in the Power Through service. ETI has requested the City deny the request to allow this application to be reviewed along with ETI's proposed rate increase, which is already pending before the PUCT. A denial of the request will allow the application to proceed before the PUCT for a full review. FUNDING SOURCE Reasonable expenses associated with rate cases are reimbursable by the company as proved for in the Public Utility Regulatory Act. RECOMMENDATION Approval of ordinance.
