WHEREAS, Orlando and Lela Cormier, the homeowners at 5770 Calder Avenue,
would like to add a second driveway which would open onto the major arterial street of
Phelan Boulevard; and,
WHEREAS, a permit for an accessory building at this address was issued on
January 20, 2022, however, the proposed driveway was not shown on the submitted
plans, nor was a drive permit requested or granted; and,
WHEREAS, the second driveway will allow access to the accessory building and
no other route is available but from Phelan Boulevard; and,
WHEREAS, City staff were later notified that the applicant's contractor had
removed a section of the curb and had started construction on the proposed driveway,
therefore, a Stop Work Order was immediately issued; and,
WHEREAS, upon review of the requested driveway, City staff considered a variety
of factors including the impact on traffic and safety the new driveway would impact along
the major arterial street; and,
WHEREAS, City staff considered the request and is recommending denial of a
driveway permit to allow for a second driveway to serve 5770 Calder Avenue as entering
or exiting a residential driveway at this location could potentially cause an unsafe
condition due to interruptions in traffic flow and possible collisions; and,
WHEREAS, the City Council of the City of Beaumont, Texas is of the opinion that
issuance of such driveway permit is in the best interest of the City of Beaumont and its
citizens;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the statements and findings set out in the preamble to this resolution are hereby,
in all things, approved and adopted; and,
THAT a driveway permit to allow for a second driveway to serve 5770 Calder
Avenue, as shown on Exhibit "A," attached hereto and made a part hereof for all purposes,
is hereby granted to Orlando and Lela Cormier.
The meeting at which this resolution was approved was in all things conducted in
strict compliance with the Texas Open Meetings Act, Texas Government Code, Chapter
551.
PASSED BY THE CITY COUNCIL of the City of Beaumont this the 22nd day of
