Adjournment COMMUNITY DEVELOPMENT ADVISORY COMMITTEE (CDAC) INTRODUCTION On behalf of the Mayor and Council, the Community Development Staff would like to take this opportunity to thank you for volunteering your time to serve on an advisory committee that you will find rewarding as well as challenging. We trust that your commitment will prove to be an inspiration and benefit to the Beaumont community. The purpose of this packet is to familiarize you with information that will be beneficial as you make recommendations in your role as a member of the Community Development Advisory Committee. MISSION STATEMENT With a firm commitment to neighborhood revitalization, the mission of Community Development is to enhance the quality of life of low to moderate income citizens through affordable housing, economic development, public service, education, employment and health care. NATIONAL OBJECTIVE FOR COMMUNITY DEVELOPMENT BLOCK GRANT ACTIVITIES According to the Housing and Community Development Act of 1974, as amended, the primary objective of the Community Development program is the development of viable urban communities, including decent housing and a suitable living environment and expanding economic opportunities principally for persons of low to moderate income. Furthermore, CDBG funds may be used for eligible activities which will carry out one of the three following national objectives: Activities must benefit low and moderate income persons. Activities must aid in the prevention or elimination of slums or blight. Activities must meet other community development needs having a particular urgency because existing conditions pose a serious and immediate threat to the health or welfare of the community and other financial resources are not available to meet such needs. An activity which fails to meet the applicable test is in noncompliance with CDBG rules. Eligible Activity Categories include: Acquisition, Disposition, Public Facilities and Improvements, Privately -Owned Utilities, Clearance and Demolition of residential structures, Public Services, Interim Assistance, Relocation, Loss of Rental Income, Removal of Architectural Barriers, Housing Rehabilitation, New Housing Construction, Code Enforcement, Historic Preservation, Planning and Capacity Building, Program Administration Costs and other Activities. COMMUNITY DEVELOPMENT ADVISORY COMMITTEE Section 2.02.061of Beaumont's City Ordinance established a Community Development Advisory Committee to be composed of twenty-one (21) members who are resident citizens of the city. The members of the Community Development Advisory Committee shall be appointed by the City Council for two-year terms. The City Council shall name one of the members as chairman and one as vice-chairman. Vacancies shall be filled by the City Council for the unexpired term. Members of the committee shall serve without compensation. According to Section 2.02.063 of Beaumont's City Ordinance, the duties and responsibilities of the Community Development Advisory Committee shall be as follows: (1) To act as an advisory board to the City Council and the City Manager; (2) To recommend objectives to the City for the Community Development Block Grant Program; (3) To assist the City Council and The City Manager's staff in planning for a continuing program of Community Development; (4) To keep the City Council and the City Manager's staff informed of current trends and to recommend changes and improvements which will update the Community Development and Housing Assistance Plan. (Ordinance 84-163, sec. 1, adopted 12/11/84; 1978 Code, sec. 2-36; Ordinance 07-010, sec. 7, adopted 2/6/07) Conflict of Interest: Members of the CDAC should be aware that conflicts of interests may arise in their role as a CDAC member. A conflict of interest occurs when a CDAC member is a board member of an organization that will be affected by a CDAC recommendation or if a member will be directly affected by the decision in any other way. When a conflict of interest does exist, the member will be expected to abstain from the vote on that particular project. CITY COUNCIL: The City Council is the final decision making authority for the Community Development Block Grant Program. All Council meetings are open to public. Citizens who have complaints about the CDBG program should register their complaint directly to the City CDBG staff either during working hours or at neighborhood meetings and public hearings. Complaints should be in written form if at all possible. The City will make every reasonable effort to provide written responses to all complaints within fifteen (15) working days. If citizens do not feel that their complaint has been answered adequately or a satisfactory solution found, they may come before the City Council and present their case. Individual activities or programs under the CDBG program may require a separate and more specific complaint procedure than the process described here. This is particularly tine of the Housing Rehabilitation Program where a complaint procedure is outlined in the Housing Rehabilitation Program Handbook. If other activities require a special complaint procedure, it will be described in a handbook made available to citizens. Otherwise, the procedure described above should be followed. Program Amendments, Prior to amending its final statement, the City shall provide citizens with reasonable notice of and opportunity to comment on such proposed changes in its use of funds. This will also provide reasonable notice whenever it decides not to carry out an activity described in the final statement, carry out an activity not previously described, or substantially (25% of entitlement) change the purpose. The City shall consider any such comments and, if the City deems appropriate, modify the changes. The City shall make available to the public, and shall submit to HUD, a description of any changes adopted. A letter transmitting such description to HUD shall be signed by the official representative of the City. Division 3. Community Development Advisory Committee EJ y See.2.02.061 Established There is hereby established a community development advisory committee to be composed of fifteen (15) members who are resident citizens of the city. The members of the community development advisory committee shall be appointed by the city council for two-year terms, expiring on September 30 of odd -numbered years. The mayor shall appoint three (3) members and each councilmember shall appoint two (2). The city council shall name one of the members as chairman and one as vice- chairman. Vacancies shall be filled by the city council for the unexpired term. (Ordinance 84-163, sec. 1, adopted 12/11/84; 1978 Code, sec. 2-34; Ordinance 07- 010, sec. 5, adopted 2/6/07; Ordinance 15-049, sec. 4, adopted 11/10/15) See.2.02.062 Secretary The city manager, or his designee, shall serve as secretary of the committee without vote. The duties of the secretary will be as follows: (1) To serve as a nonvoting member; (2) To attend all meetings of the committee and of its appointed committees; (3) To maintain a record of all activities of the committee; (4) To provide the committee with all information necessary for the performance of its duties; (5) To submit a proposed agenda to the committee chairman and members; (6) To invite the participation of the interested parties concerned with topics of the agenda; (7) To coordinate the attendance of staff personnel of the city; (8) To introduce items on the agenda and present applicable information as shall be necessary to aid in resolving problems; (9) To provide such clerical -administrative support as is required by the committee; (10) To arrange for all meetings to be held as directed by the chairman of the committee. (a) Applicability and adoption of the citizen participation plan. (1) The jurisdiction is required to adopt a citizen participation plan that sets forth the jurisdiction's policies and procedures for citizen participation. (Where a jurisdiction, before August 17, 2015, adopted a citizen participation plan it, will need to amend the citizen participation plan to comply with provisions of this section.) (2) Encouragement of citizen participation. The citizen participation plan must provide for and encourage citizens to participate in the development of the consolidated plan, any substantial amendment to the consolidated plan, and the performance report. These requirements are designed especially to encourage participation by low- and moderate -income persons, particularly those persons living in areas designated by the jurisdiction as a revitalization area or in a slum and blighted area and in areas where CDBG funds are proposed to be used, and by residents of predominantly low - and moderate -income neighborhoods, as defined by the jurisdiction. A jurisdiction must take appropriate actions to encourage the participation of all its citizens, including minorities and non-English speaking persons, as provided in paragraph (a)(4) of this section, as well as persons with disabilities. The jurisdiction shall encourage the participation of local and regional institutions, Continuums of Care, and other organizations (including businesses, developers, nonprofit organizations, philanthropic organizations, and community -based and faith -based organizations) in the process of developing and implementing the consolidated plan. (iii) The jurisdiction shall encourage, in conjunction with consultation with public housing agencies, the participation of residents of public and assisted housing developments (including any resident advisory boards, resident councils, and resident management corporations) in the process of developing and implementing the consolidated plan, along with other low-income residents of targeted revitalization areas in which the developments are located. The jurisdictions shall make an effort to provide information to the PHA about affirmatively furthering fair housing strategy, and consolidated plan activities related to its developments and surrounding communities so that the PHA can make this information available at the annual public hearing(s) required for the PHA Plan. (iv) The jurisdiction should explore alternative public involvement techniques and quantitative ways to measure efforts that encourage citizen participation in a shared vision for change in communities and neighborhoods, and the review of program performance; e.g., use of focus groups and the Internet. (3) Citizen comment on the citizen participation plan and amendments. The jurisdiction must provide citizens with a reasonable opportunity to comment on the original citizen participation plan and on substantial amendments to the citizen participation plan, and must make the citizen participation plan public. The citizen participation plan must be in a format accessible to persons with disabilities, upon request. (4) The citizen participation plan shall describe the jurisdiction's procedures for assessing its language needs and identify any need for translation of notices and other vital documents. At a minimum, the citizen participation plan shall require that the jurisdiction take reasonable steps to provide language assistance to ensure meaningful access to participation by non -English-speaking residents of the community. https://ecfr.federalregister.gov/currentltitle-24/subtitle-Apart-91 112 917/21, 12:38 PM eCFR :: 24 CFR Part 91 -- Consolidated Submissions for Community Planning and Development Programs (b) Development of the consolidated plan. The citizen participation plan must include the following minimum requirements for the development of the consolidated plan: (1) (i) The citizen participation plan must require that at or as soon as feasible after the start of the public participation process the jurisdiction will make the HUD -provided data and any other supplemental information the jurisdiction plans to incorporate into its consolidated plan available to its residents, public agencies, and other interested parties. The jurisdiction may make the HUD -provided data available to the public by cross-referencing to the data on HUD's website. (ii) The citizen participation plan must require that, before the jurisdiction adopts a consolidated plan, the jurisdiction will make available to residents, public agencies, and other interested parties information that includes the amount of assistance the jurisdiction expects to receive (including grant funds and program income) and the range of activities that may be undertaken, including the estimated amount that will benefit persons of low- and moderate - income. The citizen participation plan also must set forth the jurisdiction's plans to minimize displacement of persons and to assist any persons displaced, specifying the types and levels of assistance the jurisdiction will make available (or require others to make available) to persons displaced, even if the jurisdiction expects no displacement to occur. (iii) The citizen participation plan must state when and how the jurisdiction will make this information available. (2) The citizen participation plan must require the jurisdiction to publish the proposed consolidated plan in a manner that affords its residents, public agencies, and other interested parties a reasonable opportunity to examine its content and to submit comments. The citizen participation plan must set forth how the jurisdiction will publish the proposed consolidated plan and give reasonable opportunity to examine each document's content. The requirement for publishing may be met by publishing a summary of each document in one or more newspapers of general circulation, and by making copies of each document available on the internet, on the jurisdiction's official government website, and as well at libraries, government offices, and public places. The summary must describe the content and purpose of the consolidated plan and must include a list of the locations where copies of the entire proposed document may be examined. In addition, the jurisdiction must provide a reasonable number of free copies of the plan to residents and groups that request it. (3) The citizen participation plan must provide for at least one public hearing during the development of the consolidated plan. See paragraph (e) of this section for public hearing requirements, generally. (4) The citizen participation plan must provide a period, not less than 30 calendar days, to receive comments from residents of the community on the consolidated plan. (5) The citizen participation plan shall require the jurisdiction to consider any comments or views of residents of the community received in writing, or orally at the public hearings, in preparing the final consolidated plan. A summary of these comments or views, and a summary of any comments or views not accepted and the reasons why, shall be attached to the final consolidated plan. littps://ecfr.federalregister.gov/current/title-24/subtitle-Apart-91 2/2 2021 HUD CONSOLIDATED GRANT PROGRAM As of 5/14/2021 FINAL COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) 2021 Budget CLEARANCE AND DEMOLITION 300,000 Funds will be used to demolish unsafe, unsanitary and uninhabitable residential structures located in low to moderate income areas. PUBLIC FACILITY & IMPROVEMENT (Special Projects to be determined) 220,406 HOUSING MINOR REPAIR — (Habitat for Humanity) 317,716 Funds will be used to repair approximately 12 homes at $25,000 each, for the elderly and disabled. PROJECT DELIVERY COST — HABITAT FOR HUMANITY 52,000 Rehabilitation Administration (Project Delivery Costs) Funds will be used for personnel and operating expenses necessary for compliance with the planning, execution, 52,000 and regulatory requirements associated with the implementation of the housing Repair Program. PUBLIC SERVICES (15%) 200,000 Public Service Organizations Funds will be used for administrative and operating costs for various public service organizations that provide services to low/moderate income citizens. ADMINISTRATION (19%) 263,118 Funds will be used for personnel and operating expenses necessary for compliance with the planning, execution, and regulatory requirements associated with the implementation of the HUD Consolidated Grant Program. Our first phase of 40 homes, based on 2018 taxes, will generate on average an ROI of taxes in the amount $4,952.88 per home, which means $198,115 of taxes per year for the fast phase.
