HomeMy WebLinkAboutRES 21-104RESOLUTION NO. 21-104 WHEREAS, on January 12, 2021, the City Council of the City of Beaumont, Texas, passed Resolution No. 21-002 authorizing the City Manager to execute a pipeline easement and temporary work space easement to ExxonMobil Oil Corporation for consideration of $482,409.00; and, WHEREAS, ExxonMobil Oil Corporation has requested the City to grant one (1) additional ten foot (10') wide temporary work space for an access road situated in the C. Hillebrandt Survey, Abstract No. 28, as described and shown in Exhibit "1," attached hereto; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the statements and findings set out in the preamble to this resolution are hereby, in all things, approved and adopted, and, THAT the City Manager be and he is hereby authorized to execute the Temporary Workspace Agreement or Temporary Access Agreement as described above with ExxonMobil Oil Corporation for consideration of $1,400.00. The meeting at which this resolution was approved was in all things conducted in strict compliance with the Texas Open Meetings Act, Texas Government Code, Chapter 551 PASSED BY THE CITY COUNCIL of the City of Beaumont this the 27th day of April, 2021 N1il.11% III%t./, TEMPORARY WORKSPACE AGREEMENT or TEMPORARY ACCESS AGREEMENT THIS AGREEMENT, dated the day of 2021, is by and City of Beaumont Texas, hereinafter referred to as PERMITOR, and Exxon Mobil Oil Corporation, a New York corporation hereinafter referred to as PERMITTEE. PERMITTEE proposes to utilize PERMITOR'S property more particularly described or shown on Exhibit "A" which is attached hereto and made a part hereof by reference. Said property to be used by PERMITEE for use of temporary access road(s) associated with pipeline construction to take place in Jefferson County, Texas. 2049.36 acres of land, more or less situated in the Christian Hillebrandt Survey, A-28, Jefferson County, Texas, more particularly described as 2,183.50 acres of land, more or less, in General Warranty Deed dated January 31, 1990 from Harry Holloway, et ux, to the City of Beaumont, recorded under County Clerk's file number 9003030, Official Public Records, Jefferson County, Texas, less and except any conveyances heretofore made. PERMITOR hereby grants to PERMITTEE the right to temporarily utilize an agreed upon portion of PERMITOR'S property for the purpose hereinabove stated, subject to the following terms and conditions: 1) PERMITEE agrees to pay PERMITOR $1,400.00 for the temporary use of PERMITOR's property. The term shall be 365 days from the date of entering the property with equipment. 2) PERMITTEE shall, if necessary, be allowed to install gates in PERMITTOR'S fencing as required for access to PERMITTEE'S pipeline easement. 3) Upon completion of its use of said property, PERMITTEE shall restore PERMITOR'S property to a state equal to its condition prior to the activities conducted by PERMITTEE, or, 4) PERMI FTEE shall be responsible for the cost of prompt repair of PERMI FOR's property resulting from damage incurred as a result of PERMITEE's use of said property. IN WITNESS WHEREOF, the parties hereto have caused this instrument to be executed in duplicate the day and year first written above. This Agreement may be executed in counterparts and as so executed shall constitute one Agreement binding on all parties hereto, notwithstanding that all the parties have not signed the original or the same counterpart.
