BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF BEAUMONT:
THAT the City Manager be and he is hereby authorized to execute an Interlocal
Agreement between the City of Beaumont and Jefferson County Drainage District No. 6
(DD6) for the Elinor Street Project. The Interlocal Agreement is substantially in the form
attached hereto as Exhibit "A" and made a part hereof for all purposes.
The meeting at which this resolution was approved was in all things conducted in
strict compliance with the Texas Open Meetings Act, Texas Government Code, Chapter

This Agreement between the Jefferson County Drainage District No. 6, a special district of
the State of Texas (hereinafter called "DISTRICT") and the City of Beaumont, a home rule city of
the State of Texas (hereinafter called "CITY") under authority of the Interlocal Cooperation Act,
Chapter 791 of the Texas Government Code.
WHEREAS the DISTRICT and the CITY are working together to make improvements to
the City's drainage infrastructure in Beaumont, Jefferson County, Texas, in the area of Washington
Blvd. and 8" Street under City streets;
WHEREAS, the DISTRICT is installing culverts, under 8°' Street near Washington Blvd;
WHEREAS, the CITY owns and maintains the afore -mentioned streets, and the
DISTRICT and the CITY are desirous of reciting in writing, certain duties and obligations between
the parties hereto with regards to this Elinor Street project;
THEREFORE, the DISTRICT and the CITY agree as follows:

WITNESSETH
1. The DISTRICT agrees to reimburse the CITY for one hundred (100% of their
costs, not to exceed $70,000.00, related to water and sewer Tine adjustments that
will be performed to allow for the culvert installations;
2. The CITY will purchase and supply pipe and appurtenances for the utility
adjustments and installations. The CITY will supply manpower to make tie-ins and
lay water and sewer lines;
3. The DISTRICT will competitively procure materials, manpower, and equipment to
make repairs to concrete and asphalt CITY roads damaged by the DISTRICT
during the construction of the project(s). The estimated time frame for completion
is seven (7) to eleven (I I) weeks and shall not exceed fifteen (15) weeks weather
permitting; and
4. On a monthly basis or greater, at its convenience, the CITY will invoice the
DISTRICT for one hundred (100%) of the costs to date, up to $70,000.00 for utility
adjustments. The invoice will include all back-up documentation thatjustifies the
invoice amount, such as material invoices, equipment use cost, labor cost, and
contractor invoices. If a contractor is used, documentation must be provided to
prove the contractor was hired using a fair method to solicit the bid(s) and the
lowest bidder or bidder to the best interest of the DISTRICT was hired. All
contractors must be checked for disbarment and proof of the verification must be
provided. The DISTRICT will then reimburse the CITY for one hundred (100%)
of the total costs invoiced. All documentation for expenses must be in a format
accepted by the Texas Water Development Board (TWDB) as the administrator of
this grant for FEMA.
5. The DISTRICT shal I reimburse the CITY within thirty (30) days of the date of the
invoice. If an invoice is in dispute and cannot be resolved among the parties; the
issue shall be mediated by a mutual approved mediator. The cost for mediation shall
be divided evenly between the parties.
6. Venue for all disputes arising from this agreement shall be in Beaumont, Jefferson
County, Texas.
