BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF BEAUMONT:
THAT the City Manager be and he is hereby authorized to execute a Memorandum of
Understanding with Jefferson County Drainage District No. 6 relating to Texas Water
Development Board (TWDB) watershed study grant funding. The Memorandum of
Understanding substantially in the form attached hereto as Exhibit "A" and made a part
hereof for all purposes.
The meeting at which this resolution was approved was in all things conducted in
strict compliance with the Texas Open Meetings Act, Texas Government Code, Chapter
551.
PASSED BY THE CITY COUNCIL of the City of Beaumont this the 24th day of
November, 2020.

TEXAS WATER CODE SECTION 15.005
MEMORANDUM OF UNDERSTANDING
This is a Memorandum of Understanding (MOU) between Jefferson County Drainage
District No. 6 ("DD6") and the governing body of . City of Beaumont (the "City of
Beaumont").
WHEREAS, pursuant to Texas Water Code § 15.005 and 31 Texas Administrative
Code § 363.4,08, if the Executive Administrator determines that an application has flood
control as one of its purposes and that the watersheds in which the project is located are,
partially located outside the political subdivision making the application, the applicant must
submit a written Memorandum of Understanding relating to the management of the
watersheds in which the project is to be located, signed by.all governing bodies of eligible
political subdivisions located in the project watersheds; and
WHEREAS, DD6 has filed an application with the Texas Water Development Board
for funding a project that has flood control as one of its purposes; and
WHEREAS, DD6 has determined that the watershed(s) in which the project is located
As/are partially located within the jurisdiction of City of Beaumont; and
NOW THEREFORE, in consideration of the benefits to the Taylor Bayou Watershed,
Hillebrandt Bayou Watershed, and Pine Island Bayou Watershed, and the State of.Texas, DD6
and City of Beaumont agree to the following:
L. DD6 will provide quarterly progress updates to City of Beaumont as.the _project
develops and changes.
2. DD6 will notify City of Beaumont of any potential change in impacts to City of
Beaumont within the quarter of the identified change.
3. City of Beaumont will provide constructive input to DD6 as the project develops
and changes.

4. DD6 and City of Beaumont will work cooperatively for the management of the
Taylor Bayou Watershed, Hillebrandt Bayou Watershed, and Pine Island Bayou
Watershed.
