BACKGROUND The Beaumont Police Department utilizes a public record database with TransUnion Risk and Alternative,Data Solutions, Inc. to provide comprehensive information that is essential for investigations. This database yields broad results including names, addresses and vehicle registrations. This agreement will be for a term of one year at a rate of $280 per month. This is an increase over last year's rate -of $170 per month, but doubles the number of queries coveted by the monthly fee from 6,000 to 12,000. FUNDING SOURCE General Fund — Police Department. PRICING SUPPLEMENT This Pricing Supplement and attached Pricing Sheet (collectively, the "Supplement") is incorporated into and supplements the then -current Law Enforcement Agency Subscriber Agreement ("Agreement") between TransUnion Risk and Alternative Data Solutions, Inc. ("TRADS") and the Agency. The Agency agrees as follows: 1. Effective Date; Term. The Effective Date of this Supplement is specified in the Pricing Sheet. This Supplement shall commence upon the Effective Date and continue for the period specified in the Pricing Sheet ("Supplement Term"). Upon expiration of the Supplement Term, the Agreement will continue in effect in accordance with the terms therein, absent this Supplement, subject to TRADS's then -current fees and charges for the TRADS Services accessed thereafter. Agency agrees to be bound by this Supplement and agrees to pay all fees and charges set forth in the Pricing Sheet during the Supplement Term. 3. Miscellaneous. In the event of a conflict between the terms of this Pricing Supplement and any prior pricing supplement, agreement or understanding with respect the TRADS Services identified herein, the terms of this Pricing Supplement shall supersede, control and otherwise replace. In the event any one or more provisions of this Supplement, or the Pricing Sheet, is held to be invalid or unenforceable, the enforceability of any remaining provision(s) shall be unimpaired. All capitalized terms used but not defined in this Supplement will have the same meanings as defined in the Agreement. Except as provided in this Supplement, all other terms the Agreement shall remain in full force and effect in accordance with its terms. PURPOSE The DEPARTMENT OF STATE HEALTH SERVICES ("SYSTEM AGENCY" OR "DSHS"), a pass -through entity, and BEAUMONT PUBLIC HEALTH DEPARTMENT ("GRANTEE") (each a "Party" and collectively the "Parties") enter into the following grant contract to provide funding for COVID-19 activities (the "Contract"). Singletary, Chief of Police MEETING DATE: August 11, 2020 REQUESTED ACTION: Council consider a resolution authorizing the City Manager to execute all documents necessary to apply for and accept grant funding from the Motor Vehicle Crimes Prevention Authority. BACKGROUND For 28 consecutive years, the Southeast Texas Auto Theft Task Force (ATTF) has been a multi - jurisdictional, cooperative law.enforcement effort -designed to regionally combat auto burglaries. It is partially grant -funded by the Motor Vehicle Crimes Prevention Authority (MVCPA), formerly named Automobile Burglary and Theft Prevention Authority (ABTPA).. Although ATTF.is centered in and administered by the City of Beaumont, it is inclusive of Jefferson, Hardin, Orange, and Jasper counties. The City of Beaumont has been the grantee for the Southeast Texas Auto Theft Task Force since 1993. The total budget being requested is $890,340, with state funds in the amount of $528,714, The Beaumont Police Department will provide $226,250 as a cash match in the form of personnel salaries, benefits, fuel and vehicle maintenance, while other agencies will provide an additional $135,376 for a total cash match of $361,626. The upcoming grant cycle will begin on September 1, 2020 and will end on August 31, 2021. FUNDING SOURCE The city's required match is included in the Police Department's Operating Budget in the General Fund. RECOMMENDATION Approval of the resolution. Fuel, Oil, & Maintenance ($42,750): Fuel costs are estimated based on 13,000 miles per year, 14 miles per gallon @ $2.25 per gallon, totaling approximately $2100: per vehicle per year. Oil changes and other maintenance costs are estimated at $2200 per vehicle per year to include expendables such as tires, brakes, shocks, or other necessary repairs. Combining estimates result in an average cost of S4300 per year multiplied by nine (9) vehicles totaling $38,700. The $4300 shown for the one vehicle previously budgeted by BPD is listed as an in -kind match whereas the remaining S34,400 is listed as a cash match. These estimates are not allocated. WHEREAS, on May 26, 2020, the City Council of the City of Beaumont, Texas approved Resolution No. 20-105 designating the City Manager, Kyle Hayes, as the Authorized Official to apply for, accept, decline, modify or cancel the grant application for the Automobile Burglary and Theft Prevention Authority Grant Program; and, WHEREAS, Resolution No. 20-105 also designated Southeast Texas Auto Theft Task Force Commander, Lt. The easement is described as being a 0.4854 acre tract of land situated in the F. Bigner Survey, Abstract No. 1, City of Beaumont, Jefferson County, Texas. The easement is for the construction of new apartments located at 6120 Folsom Drive.. FUNDING SOURCE Not applicable. RECOMMENDATION Approval of the resolution. RESOLUTION NO. BACKGROUND Delta Manor, LP has agreed to convey a 25,207 square foot ten foot (10') wide exclusive Water Line Easement to the City of Beaumont. The easement is described as being a 0.5787 acre tract of land situated in the F. Bigner Survey, Abstract No. 1, City of Beaumont, Jefferson County, Texas. The easement is for the construction of new apartments located at 5740 Northwest Parkway. FUNDING SOURCE Not applicable. RECOMMENDATION Approval of the resolution. RESOLUTION NO. WHEREAS, Delta Manor, LP has agreed to convey one (1) twenty-five thousand, two hundred seven (25,207) square foot ten foot (10') wide exclusive water line easement, said easement being a 0.5787 acre tract of land situated in the F. Bigner Survey, Abstract No. 1, City of Beaumont, Jefferson County, Texas as described and shown in Exhibit "1," attached hereto, to the City of Beaumont to facilitate the construction of a new apartment complex located at 5740 Northwest Parkway; and, WHEREAS, the City Council has considered the purpose of said conveyance and is of the opinion that the acceptance of said conveyance is necessary and desirable and is in the best interest of the City of Beaumont and that same should be accepted; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the statements and findings set out in the preamble to this resolution are hereby, in all things, approved and adopted; and, THAT one (1) twenty-five thousand, two hundred seven (25,207) square foot ten foot (10') wide exclusive water line easement, said easement being a 0.5787 acre tract of land situated in the F. BACKGROUND Chapter 26 of the Property Tax Code requires taxing units to comply with truth -in -taxation laws in adopting their tax_ rate and requires the governing body to hold a public hearing when the - - proposed tax rate exceeds the lower of the no -new revenue or voter -approval tax rate. Administration recommends Council establish a tax rate required to supportthe City Manager's proposed budget equal to the tax rate of $0.71/$100 of valuation. In accordance with Chapter 26 of the Property Tax Code, if the proposed rate exceeds the no -new revenue rate of $0.691019/$100 or the voter -approval tax rate_ of $0.734583/$100, the City Council must take a record vote to place the proposal to adopt the rate on the agenda of a -future meeting. The no - new revenue tax rate is the rate that would -produce the same amount of taxes in FY 2021 as was produced in FY 2020 if it was. applied to the same properties taxed -in both years. The proposed. tax rate of $0.710000/$100 exceeds the no -new revenue tax rate of $0.691019/$100 by . $0.018981/$100 or 2.7%. If the motion passes, a public hearing must be scheduled. It is recommended that the public hearing be held on September 15, 2020 at 1:30 p.m. in the Council Chambers. FUNDING SOURCE Not applicable.
