HomeMy WebLinkAboutRES 76 344WHEREAS, The City.of Beaumont and the Port of Beaumont, both entities being governmental bodies of The,State of Texas,.each vested with the power of eminent domain, desire to exchange certain properties; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: 1. THAT the hereinafter -referenced tracts or parcels of land to be conveyed by The City of Beaumont to the Port of.Beaumont will better serve the public for port purposes, and that it is necessary for the Port of Beaumont to acquire said parcels for such use, and that such use by the Port of Beaumont is paramount to its use by The City of Beaumont. 2. THAT the hereinafter -referenced tracts or parcels of land to be conveyed by the Port of Beaumont to The City of Beaumont'.will better serve the public for City Civic Center purposes,and that it is necessary for The City of Beaumont to acquire said parcels for,, ;such use, and that such use by The City of Beaumont is paramount to its use by the Port of'Beaumront. 3. THAT the City Manager be, and he is hereby, authorized to execute an.instrument or instruments conveying fee title in and to certain tracts or par- cels of land generally described as follows: (A) Tract B.- A 0„604 acre tract of land located east of Cypress Street between Hickory Street (closed) and Tevis Street (closed). (B) Tract C - A 0.332 acre tract of land located east of Cypress Street.between Tevis Street (closed) and Mulberry Street (closed). '(C) Tract D - A 0.502 acre tract -of -land presently used as a railroad easement to tie the KCS main line to the Port Exchange Yard (located -in Block 4.of the.'Original Beaumont Township). (D) Tract E - Lots 741 - 745, Block 21.of.the Ori- ginal Beaumont Township,, located west of Cy press Street between Mulberry Street and Eliza- beth Street, and containing 0.826 acres. (E) Tract F*.;- A 4.815 acre tract bounded by Wallace Street, the.KCS. Railroad.line.(Finis Street) and Port of Beaumont property (formerly F.,ethune Ele- mentary School site); of Beaumont to. The City of Beaumont of certain tracts or parcels of land gener- ally described as followsr. (A) Tract A - A 0.0.37 acre tract of land between' Main Street and Market. Street adjacent to Forsythe Street. (B) Tract 1 - A 2.843 acre tract of land (irregu- 'larly shaped) located between Cypress Street, Market Street, Gilbert Street and the proposed expansion of the Railroad '-Port Exchange Yard. 4. THAT at the time of passage of this resolution, the metes and bounds descriptions of the parcels of land, including those the City will con- vey, and those to be.conveyed'by the Port, have not been prepared, but are cow putable from that certain plat prepared by Schaumburg & Polk, Inc.,.Consulting . Engineers, and used by the City and the Port in previous negotiations, and it is the intent of the Council.to refer to those parcels so identified on said plat, and to authorize the City Manager to make such conveyance of those par-' cels so identified as soon as the metes and bounds descriptions become available.
