HomeMy WebLinkAboutRES 76 2052 1 k - 76-a®.6 R E S 0 L U T I 0'N WHEREAS, the City Council of The City. of Beaumont deems it necessary to locate, construct, maintain, straighten, widen and extend Sarah Street in The City of Beaumont, Jefferson County, Texas; and, WHEREAS, said City.Council has .found that public necessity requires the location, construction, maintenance, straightening, widening and extension of said street on the hereinafter described property; and, WHEREAS, said City Council deems it necessary to acquire the hereinafter described interest in and to the hereinafter de- scribed property for said location, construction, maintenance, straightening, widening and extension of said street, and the said City Council has found and determined that the said interest in and to the hereinafter described land is suited for such purposes and that it is necessary to acquire same for said purposes; and, WHEREAS, The City of Beaumont, through its duly authorized representatives, has negotiated with the owners of the hereinafter described land and has been unable to agree with the owners of such property.as to the fair cash value thereof and damages, if any, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT Kenneth Wall, City Attorney, or his designee, be, and he is hereby, authorized and directed.to file or cause to be filed against all owners or claimants thereof of :the hereinafter described pro- perty, Proceedings in Eminent Domain to acquire fee title, for said purposes,in and to the following described parcel of land situated in Beaumont, Jefferson County, Texas, to wit: BEING a 1,OOG.0 square foot tract of land situated in the J. W. Bullock League and being out of the Valmore Cormier 3 acre City of Beaumont as recorded in Volume 3, Page 58 of the Map Records of Jefferson County, Texas, this described tract being out of that certain tract conveyed to Mer - la Mae Chevis Simon, et al, as recorded in Volume 1799, Page 93 of the Deed Records of said county and state, said conveyance also being designated as Tract 34, Plat E- ll on the plat maps of the Tax Assessor's Office of The City of Beaumont, said tract being more particularly described by metes and bounds as follows, to wit: For a LOCATIVE POINT, the intersection of the South line of Sarah Street and the West line of Broussard Street same being the East line of the Valmore Cormier 3 acre tract; THENCE North 890 56' West, 59.0 feet along the existing South line of Sarah Street to the PLACE OF BEGINNING of the herein de- scribed tract; THENCE continuing North 891 56' West, 50..0 feet along said South line to a point for corner; THENCE South 00° 041. West, 20.0 feet to a point for corner in the proposed South line of Sarah Street; THENCE South 890 56' East, 50.0 feet along the proposed South line of Sarah Street to a point for corner; THENCE along said East line North 0.01 04' East, 20.0 feet to a point for corner being the PLACE OF BEGINNING of the herein de- scribed tract of land; Containing 1,000.0 square feet of land, more or less. Provided, however, there is excluded from said estate to be condemned and reserved to the owners thereof, all the oil, gas and sulphur beneath said land; and provided further_ that the rights of access, ingress and egress to and from said Sarah Street to the remaining premises of defendants are not to be condemned.
