HomeMy WebLinkAboutRES 75 3694-%`E)-Nq R E S O L U T I O N WHEREAS, the City Council of The City of Beaumont deems it necessary to locate, construct, maintain, straighten, widen and extend Delaware Street in The City of Beaumont, Jefferson County, Texas; and, WHEREAS, said City Council has.found that public necessity requires the location, construction; maintenance, straightening, widening and extension of said street .on the hereinafter de- scribed.property; and, WHEREAS, said City Council deems it necessary to acquire the hereinafter described interest in and to the hereinafter described property for said location, construction, maintenance, straightening, widening and extension of said street, and the said City Council has found and determined that the said in- terest in and to the hereinafter described land is suited for such purposes and that it ,is necessary to acquire same for said purposes; and, WHEREAS, The City of Beaumont, through its duly authorized representatives, has negotiated with the owners of the herein- after described land and has been'•unable to agree with the owners of such property as to the fair cash value thereof and damages, if any, NOW, THEREFORE, BE IT RESOLVED.BY;THE CITY COUNCIL OF THE CITY OF BEAUMONT, TEXAS: That Kenneth Wall, City Attorney, be, and he is hereby, authorized and directed to file or cause to be filed against all owners of the=. -hereinafter described property, and .claimants of interest therein, Proceedings in,Eminent Domain to acquire fee title, for said purpose, in and --to theIfollowing described parcel of land situated in Beaumont, Jefferson County, Texas, to -wit: BEING a 2450 square,foot tract of land and being 15 feet along..West.Lucas Drive and 163.33 feet along Delaware' Street and being the North 5.85 feet of Lot l and the South 9.15 feet of Lot 2, Block 29, Calder High- lands Addition, plat of which is recorded in Volume 4, Page 155, Map; Records, Jefferson County, -Texas, described -by metes and bounds as follows: BEGINNING at the Northeast corner of said Lot 1 and the Southeast corner of said Lot 2, Block 29 of the said Calder.Highlands Addition, said beginning point being in the West right of way line of .West Lucas Drive, said beginning point being the Northeast corner of the W. R. Williams tract as des- cribed in Volume 526, Page 574., Deed Records, Jefferson County,,Texas,and the Southeast corner of the W.. R. Williams tract as des- cribed in Volume 545, Page 221, Deed Records, Jefferson County,, Texas; THENCE South OO.deg. 50';East along the East line of Lot 1 and the West right of way line of Lucas Drive a distance of 5.85 feet to an iron rod for corner; THENCE South 89 deg. 10'.West parallel to the North line of said Lo.t 1 a distance of 163.33 feet to an iron rod for corner in the West line -of said Lot 1; THENCE.North OO'deg. 50' West along the West line of Lot 1 ata distance of 5.85 feet pass the Northwest corner of Lot.l and the South- west corner of said Lot!.2 and continuing along said course for a total distance of 15.00 feet to a concrete monument for corner in the West line of said Lot.2 and the South line of the existing Delaware Street, an.80 foot wide right of way;�as described in Volume 1456, Page 565,;Deed Records, Jefferson County, Texas; THENCE North 89 deg. 10''East along the South right of way line of the existing Delaware Street and parallel to' the South line of said Lot 2 a distance of 163.33 feet to an iron rod for corner in the West right of way line of West Lucas Drive; THENCE South 0.0 deg. 50' East along the East line of Lot 2:and the'West`right of way line of West Lucas -Drive a "distance of 9.15 feet to the place of beginning. Provided, however, there is excluded from said estate to be condemned and reserved to the owners -thereof all the oil, gas and sulphur.beneath said land; and provided further that the rights of access, ingress and egress to and from the said Delaware Street of the remaining premises of defendants are not to be condemned.
