R E S O L U T I O N
BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF BEAUMONT:
THAT the firm of Harland Bartholomew and Associates International,
Inc. be retained as consulting engineers for consultation on the
Beaumont Railroad Relocation Project at a fee as set out in the rate
schedule in the letter agreement attached to this resolution and
made a part hereof for all purposes.
PASSED BY THE CITY COUNCIL of the City of Beaumont this the

This letter proposal will confirm our discussions regarding your desire
to retain Harland Bartholomew and Associates for consultation on the Beaumont
Railroad Relocation Project.
We'will be glad to provide consulting services as needed with regard to
liaison between the city, the railroads involved, the State and Federal agencies,
and the Congressional staffs. These services will consist of meetings with you
and the local, State and Federal officials and agencies involved in the project;
assisting in developing a schedule for the work elements that must be completed
in connection with Federal and State requirements; and assisting in the translation
of legislative and governmental guidelines in order that the project may be
developed in an orderly, efficient manner.
We will be available to meet with you on call and to discuss matters by
telephone when needed. We will provide letter reports to you on these matters
when appropriate. The scope of our services necessarily must be flexible to meet
your specific needs. We anticipate that the undersigned would provide most of
the services on this particular project, however, others of our staff would be
available also when needed.
Our compensation will be determined on a per diem plus expenses basis
wherein we will bill you only for time actually spent on your project plus such
direct costs as travel, subsistence, and printing (if any). Our current per diem
rates for the categories of personnel likely to be involved in this work are indicated
on the schedule below, which is effective for the remainder of this year. The per
diem rates are subject to annual review and modifications.

In the event that we mutually agree that major work efforts on our part are
desirable we will advise you prior to continuing that work effort and if the level of
study requires such, we would develop a separate agreement. This procedure would
be followed in the event that you desired to employ us to do elements of the
Environmental Impact Statement, assist with public hearing requirements or to
provide substantial planning or engineering services.
have prepared this letter in a format which will permit you to indicate
your approval and this letter will serve as our agreement. Please sign in the space
below, retaining one copy for your files and returning one to us. Your approval
will permit us to proceed with assistance to you under the terms of this letter until
you decide that our services are no longer required. Either party can terminate this
agreement by providing written notification to the other party.
