WHEREAS, the City ` of_ Beaumont. and -..J. C. N. 'Pavers:, Inc. entered
into a certain'agreement on February 19,, 1974, to'furnish all labor,
superintendence, material and equipment to perform a f.work necessary
to the construction of Revenue:Sharing,Project No. RS=T-11, which is
the .same. as Phelan Boulevard', Phase II; and,
WHEREAS',; Change -Order ,No. 3,t6 :said. contract. has been, proposed',
undet-which said change.order'; Q: C. N. Pavers, Inc. is to turn the newly
constructed storm sewer. on..Dowlen .Road" across the- .road'. and -intersect
the.Keith'Ditch.on the'downstream side,.of.Dow ILen Road, which'would over-.,
come the effect.of.the water -,backing up in the Keith ,Ditch ori the west'.-
side of Dowlen: Road; and;.
WHEREAS; the total additionalcost,: of this change order i.s
$14,542.00, for a total revised contract cost of $.1,414,951.55, which
amount of $14,542 00.i,s'available i7ithin the. Revenue.Sharing construc-
tion budget;
NOW; THEREFORE;' BE .IT RESOLVED BY THE
CITY. COUNCIL OF THE, CITY :OF,`BEAUMONT:
THAT the City Manager -be, and. he is',hereby,`authorized to execute on
behalf of..the City.of Beaumont the':above described change order to the
original -contract., ,and:that the -City -Clerk - is hereby authorized to
attest.to.'same and to affix.',the' Seal of the City of Beaumont thereto;
-arid,.
BE IT FURTHER RESOLVED thatthe r-tainage_on this contract be
reduced to one per cent. (1 of the contract amount, and that the re-
tainage, other than said .l be paid' to' .the .contractor
