R E S O L U T I O N
WHEREAS, the City of Beaumont has presently existing a fran-
chise with Beaumont Cablevision, Inc. to provide cable television
service to the citizens of the City of Beaumont; and,
WHEREAS, said franchise provides that Beaumont Cablevision,
Inc. is to provide cable television service to at least seventy-five
(75%) per cent of the homes within the city limits of the city of
Beaumont within sixty (60) months from the effective date of the fran-
chise; and,
WHEREAS, said franchise provides that the City of Beaumont may,
at its option, terminate the franchise for failure on the part of
Beaumont Cablevision, Inc. to so provide service; and,
WHEREAS, the City Council of the City of Beaumont desires to
express its intention not to exercise any termination rights available
to the City of Beaumont occasioned by any failure by Beaumont Cable-
vision, Inc. to provide cable television service to at least seventy-
five (75%) per cent of the homes in the city as provided in the fran-
chise until January 1, 1976;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the. City of Beaumont hereby declares its intention not to exercise
any option it may have to terminate the existing franchise between the
City of Beaumont and Beaumont Cablevision, Inc., resulting from any fail-
ure on the part of Beaumont Cablevision, Inc. to provide cable television
service to at least 75% of the homes within the city limits of Beaumont
within sixty months from the effective date of the ordinance any time
before January 1, 1976.
