HomeMy WebLinkAboutRES 75 136a + Tk 767:/3.G R 'E' S' '0' 'L' 'U 'T'I' '0' N WIIEREAS, the City of Beaumont and Coatings Application & Water- proofing Company executed a certain contract on January 14, 1975, for repairing and waterproofing all masonry on the Harvest Club Building of the City of Beaumont at a total contract price of Seven Thousand Nine Hundred Sixty -Nine and No/100 ($7,969.00) Dollars; and, WIIEREAS, the City Engineer has inspected the work and recommends its acceptance in full and final payment to the contractor; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the City of Beaumont hereby accepts the completion of the afore- said contract in all particulars and further authorizes final payment of $7,969.00 to the contractor in accordance with said.contract. PASSED BY THE CITY COUNCIL of the City of Beaumont this the day of 1fi o 19 75 . i. - - r TY' /:�" C WHEREAS, it has become necessary to reconstruct that portion of Interstate Highway 10 from 0.4 mile West of Magnolia Avenue to 0.5 mile East of the East end of the Neches River Bridge including the existing illumination system, and; WHEREAS, it is the mutual desire of the "City" and the "State" that the'portion of the agreement of October 25., 1955 pertaining to this section of Interstate Highway 10 from 0.4 mile West of Magnolia Avenue to the East City Limits of Beaumont be cancelled and that all other portions of said agreement are to remain in full force, and; WHEREAS, the State Highway Engineer,' acting for and in behalf of the State Highway Commission has made it known to the City that the State will construct said street illumination system, conditioned that the City.,as provided for in Highway Commission Minute Order No. 61624, will maintain and operate.said illumination system. AGREEMENT NOW THEREFORE, in consideration of the premises and of the mutual covenants and agreements of the parties hereto to be by them respectively kept and performed as hereinafter set forth, it is agreed as follows: 1-A ` t R_ on AGREEMENT -FOR -CONSTRUCTION, MAINTENANCE. AND OPERATION OF STREET ILLUMINATION SYSTEM WITH MUNICIPALITY STATE OF TEXAS X COUNTY OF TRAVISX This agreement made this day of 19 76 - by and between the State of Texas, hereinafter referred to i as the "State", party of the first part, and the City of Beaumont, Jefferson County, Texas, acting by.and through its duly authorized officers under an ordinance passed the resolution day of , 19 , hereinafter called the "City", party of the second part. WITNESSETH WHEREAS, the City has requested the State to contribute financial aid in the construction, maintenance and operation of the street illumination system on Interstate Highway 10 from 0'.4 mile West of Magnolia Avenue to the East City Limits of Beaumont, the route of Highway No. Interstate 10 herein- after referred to as the "street illumination system", and; WHEREAS, this section of Interstate Highway 10 presently has an existing illumination system constructed and maintained under an agreement between the "City" and the "State" dated October 25, 1955, and; Form No. 1074 Rev. 8-5-70 1. Construction Responsibilities The State will. prepare or provide for the plans and specifications, advertise for bids, and let the construction contract, or otherwise provide for the construction, and will supervise the construction, reconstruction or betterment work as required by said plans. As the project is developed to the construction stage, either as a unit or in increments, the State.will submit plans of the proposed work to the City and will secure the City's consent to construct the facility according to such plans prior to awarding a contract. All costs of constructing the street illuminating system including such items as conduits, lamp standards, mast arms, reflector. units, lamps, bowls, electrical conduc- tors, wiring, etc. will be borne by the State. It is understood that the State's financial participation in construction will not extend to and, include the construction of any primary lines and incidental equipment necessary to connect the sheet illumination system with power stations. 2. Maintenance and Operation Responsibilities The City hereby agrees at its expense to furnish the electric energy required for proper operation of the street. ilIumination system, such electric energy to be provided at points on the street illumination system as designated by the State.' The City further agrees to maintain and operate the street illumination system in an efficient and sightly condition, including the furnishing of all equipment and labor and -making any replace- ments which may become necessary, without cost to the State. . The City will assume maintenance and operation on a date to correspond with the date construction of the street illumination system is completed and accepted by the State. The City hereby agrees at its expense to furnish the electric energy consumed by the system during the period of trial operation prior to acceptance by the State. If the illumination system is constructed by sections this provision shall apply to each such separately constructed section: The City will -obtain written. approval of the State Highway Engineer before making any changes in the illumination system as designed and constructed by the State or before the removal of any part of the installation except for the purpose of replacements where identical or accepted equivalent equipment to that originally installed is used. d .
