WHEREAS, on the 10 day of January, 1974, the City of Beaumont
entered into a contract with Holloway Sand and Gravel Company to per-
form certain work as set out in the contract of that date concerning
CIP Project 12 -SU -04; and,
WHEREAS, this project is near completion and delays have occurred
with no fault or neglect on the part of the contractor; and,
WHEREAS, the engineering firm of Schaumburg & Polk, Inc. has
recommended that the retainage on this contract be reduced by the City
of Beaumont from ten (10%) per cent to five (5%) per cent; and,
WHEREAS, the City Council of the City of Beaumont finds that
this is an equitable portion of the retained percentage to be paid to
the contractor under the circumstances;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the City Finance Officer and other appropriate City Officials be,
and they are hereby, authorized to reduce the retainage on CIP Project
12 -SU -04, the same being Contract III -A of the 1971 Capital Improvements
Program, Sanitary Sewer Improvements, from ten (10%) per cent to five
(5%) per cent.
