HomeMy WebLinkAboutRES 74 350LJ/1p 8/27/74 11 -ST -02 T-4 7 V ­ 5a RESOLUTION WHEREAS, the City Council of The City of Beaumont deems it necessary to locate, construct, maintain, straighten and widen College and Fourth Streets in the City of Beaumont, Jefferson County, Texas; and, WHEREAS, said City Council has found that public necessity requires the location, construction, maintenance, straightening and widening of said streets on the hereinafter described property; and, WHEREAS, said Council deems it necessary to acquire the hereinafter described interest in and to the hereinafter described property for said location, construction, maintenance, straightening and widening of said streets, and the said City Council has found and determined that the said interest in and to the hereinafter described land is suited for such purposes and that it is necessary to acquire same for said purposes; and, WHEREAS, The City of Beaumont, through its duly authorized repre- sentatives, has negotiated with the owners of the hereinafter described land and has been unable to agree with the owners of such property as to the fair cash value thereof and damages, if any, NOW, THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT, TEXAS: THAT Kenneth Wall, City Attorney, be, and he is hereby, authorized and directed to file or cause to be filed against all owners of the hereinafter described property, and claimants of interest therein, Proceedings in Eminent Domain to acquire fee title, for said purpose, in and to the following described parcel of land situated in Beaumont, Jefferson County, Texas, to -wit: BEING a 2, 596. 67 square foot tract of land out of Lots 6 and 7, Block 21 of the Cartwright Terrace addition to the City of Beaumont, Jefferson County, Texas, as per map or plat of said addition as recorded in Volume 3, Page 147 of the Map Records of said County and State and being more particularly described by metes and bounds Y FOR the PLACE OF BEGINNING, the intersection of the existing East line of Fourth Street and the existing North line of College Street, being the existing Southwest corner of Lot 7; Block 21, of said addition; THENCE North 107. 00 feet along the existing East line of Fourth Street to a point for corner; THENCE East 10. 00 feet to a point for corner; THENCE South 64. 5 feet along the proposed East line of Fourth Street to a point for a curve; THENCE deflecting to the left along the. arc of a curve with a radius of 32. 50 feet a distance of 51. 05 feet to a point of tangency (chord of said curve bears South 45000' East, 45. 96 feet).; THENCE East 97. 50 feet along the proposed North line of College Street to a point for corner; THENCE South 10. 00 feet to a point for corner in the existing North line of College Street; THENCE West 140. 00 feet along the existing North line of College Street to a point for corner and PLACE OF BEGINNING of the here- in described tract of land; CONTAINING 2, 596. 67 square feet of land more or less. PROVIDED, however, there is excluded from said estate to be condemned and reserved to the owners thereof all of the oil, gas and sulphur beneath said land; and provided further that the rights of access, ingress and egress to or from the said College and Fourth Streets of the remaining premises of defendants are not to be condemned.
