WHEREAS, the City Council of The,City of Beaumont deemsit necessary
to :locate, construct, maintain,. straighten, widen and extend Fodrth.Street. in
The City of Beaumont, Jefferson County; Texas; and,
:WHEREAS; said City Council has found.,that public necessity requires
the location,. construction, maintenance, -.straighteningwidening and extension
Of said.,street on the hereinafter 'descr'ibed .property; and,
WHEREAS, ;s aid, City Council deems it necessary, to acquire the here
inafter' described.'interest in: and'to the hereinafter described property for said
location'; construction, maintenance, straightening, widening and extension of
said street, and, the said City CounciI.has.fou' nd and determined that the said
interest in and to.the hereinafter des-cribed-land,is suited for such purposes and
that it is. necessary to acquire same fo'r. said purposes; and;
WHEREAS,'.,The City of Beaumont, through its duly. authorized repre -
.,sentatives', has negotiated with .the, owners of the, hereinafter described land
and has been- unable.to,agree with the owners of such property as to :the fair cash
value..the r'eof� and damages,.,if any, NOW, THEREFORE,
BENT RESOLVED BY THE CITY ;COUNCIL'

to. file or"cause to befiled against all owners of the 'hereinafter describedprop-
erty, and claimants of-inter.esi..therein, •Proceedings in Eminent Domain to acquire
fee title, for' said purpose, .in and to the following described parcel of. land situated.-
in, Beaumont, JeffersonCGounty; Texas; to -wit:
TRACT I
BEING a 1,000. square foot tract of land out of Lots 4 and 5., -Block
20 of ;the Cartwright Terrace Addition to the .City of'Be'aumont,
Jefferson County,, Texas.as Per ma -

FOR a locative point, the intersection of the existing East line
of Fourth Street and the existing South line of College Street, '
being the most Northwesterly corner of Lot 1, Block 20 of said
addition;
THENCE South 143. 5 feet along the existing East line of Fourth
Street to a point for corner and PLACE OF BEGINNING of the
herein described tract of land;
THENCE East 10. 0 feet to a point for corner in the proposed East
line of Fourth Street;
THENCE South 100. 0 feet along the proposed East line of Fourth
Street to a point for corner;
THENCE West 10. 0 feet to a point for corner in the existing
East line of Fourth Street;
THENCE ,North 100. 0 feet along the existing East line of Fourth
Street to a point for corner and PLACE OF BEGINNING of the
herein described tract of land;
CONTAINING 1, 000. 0 square feet of land more or less.
TRACT II
BEING a 935. 0 square foot tract of land out of Lots 6 and 7,
Block 20 of the Cartwright Terrace Addition to the City of
Beaumont, Jefferson County, Texas as per map or plat of said
addition as recorded in Volume 3, Page 147 of the Map Records
of said County and State, and being more particularly described
by metes and bounds as follows, to -wit:
FOR a- locative point, the intersection of the existing South line
of College Street and the existing East line of Fourth Street,
ibeing the most Northwesterly corner of Lot 1, Block 20 of
said addition;
THENCE South, 243. 5 feet along the existing East line of Fourth
Street to a point for corner and PLACE OF BEGINNING of the
herein described tract. of land;
THENCE continuing South, 93.5 feet along said line to a point
for corner;
THENCE East, 10. 0 feet to a point for corner in the South line
of Lot 7 and the North line of Gilbert Street;
THENCE North, 93.5 feet along the proposed East line of Fourth
Street to a point for corner;
THENCE West, 10. 0 feet to a point for corner and PLACE OF
BEGINNING of the herein described tract of land.;
PROVIDED, however, there is excluded from said estate to be condemned
and reserved to the owners thereof all of the oil, gas and sulphur beneath said
land; and provided further that the rights of access, ingress and egress to or
from the said Fourth Street of the remaining premises of defendants are not to
be condemned.
