HomeMy WebLinkAboutRES 74 304RESOLUTION WHEREAS, the City Council of The City of Beaumont deems it necessary to locate, construct, maintain, straighten, widen and extend College Street in The City of Beaumont, Jefferson County, Texas; and, WHEREAS, said City Council has found that public necessity requires the location, construction, maintenance, straightening, widening and extension of said street on the hereinafter described property; and, WHEREAS, said City Council deems it necessary to acquire the here- inafter described interest in and to the hereinafter described property for said location, construction, maintenance,, straightening, widening and extension of said street, and the said City Council has found and determined that the said interest in and to the hereinafter described land is suited for such purposes and that it is necessary to acquire same for said purposes; and, WHEREAS, The City of Beaumont, through its duly authorized repre- sentatives, has negotiated with the owners of the hereinafter described land and has been unable to agree with the owners of such property as to the fair cash value thereof and damages, if any, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT, TEXAS: that Kenneth Wall, City Attorney, be, and he is hereby, authorized and directed to file or cause to be filed against all owners of the hereinafter described property, and claimants of interest therein, Proceedings in Eminent Domain to acquire fee, , title, for said purpose, in and to the following described parcel of land situated in Beaumont, Jefferson County, Texas, to -wit: BEING an 858. 9 square foot tract of land out of Lots 5 and 6, Block 4 of the Cartwright Terrace Addition to the City of Beaumont, Jeff- erson County, Texas, as per map or plat of said addition being of Record in said County and State, and being more particularly de- scribed by metes and bounds as follows. to -wit: THENCE South 49016' West, .119..82 feet.along the North line of College Street to a point for corner and PLACE OF BEGINNING of the herein described tract of land; THENCE continuing South 49016' West, 97. 18 feet to a point for corner; THENCE West, 2. 8 feet to point for corner in the intersection of the North line of College Street and the East line of a 200 foot Southern Pacific Railroad right-of-way; THENCE North 03051' West, 20.44 feet along said right-of-way line to a point for corner; THENCE deflecting to the left along the arc of a curve with a radius of 268. 00 feet a distance of 88. 37 feet to a point for corner (chord of said curve bears North 58042'48" East, 88. 23 feet); THENCE South 40044' East, 3. 69 feet to a point for corner and PLACE OF BEGINNING of the herein described tract of land; CONTAINING 858. 9 square feet of land more or less. PROVIDED, however, there is excluded from said estate to be condemned and reserved to the owners thereof all of the oil, gas and sulphur beneath said land; and provided further that the tights of access, ingress and egress to or from the said College Street of the remaining premises of defendants are not to be condemned.
