HomeMy WebLinkAboutRES 74 297LLJ/cb 8/1E /')- ll -ST -04 Tr &a, '741-Z 97 R E S O L U T I O N WHEREAS, the City Council of The City of Beaumont deems it necessary to locate, construct, maintain, straighten and widen East Lucas Street in The City of Beaumont, Jefferson County, Texas; and, WHEREAS, said City.Council has found that public necessity requires the location, construction, maintenance, straightening and widening of said street on the hereinafter described pro- perty; and, WHEREAS, said Council deems it necessary to acquire the hereinafter described interest in and to the hereinafter described property for said location, construction, maintenance, straighten-. ing and widening of said street, and the said City Council has found and determined that the said interest in and to the herein- after described land is suited for such purposes and that it is necessary to acquire same for said purposes; and, WHEREAS, The City of Beaumont, through its duly authorized representatives, has negotiated with the owners of the herein- after described land and has been unable to agree with the owners of such property as to the fair cash value thereof and damages, if any, NOW, THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT, TEXAS: THAT Kenneth Wall, City Attorney, be, and he is hereby, authorized and directed to file or cause to be filed against all owners of the hereinafter described property, and claimants of interest therein, Proceedings in Eminent Domain to acquire fee title, for said purpose, in and to the following described parcel of land situated in Beaumont, Jefferson County, Texas, to -wit: BEING a 199.74'square foot tract of land out of Lot 68 of French Heights Subdivision situ- ated in the A. Williams Survey, City of Beaumont, Jefferson County, Texas, as per map or plat of said subdivision recorded in Volume 6. Page 61 of the Map Records.of said county and state, said Lot 68 conveyed to Business Properties, Inc., by virtue of a deed recorded in Volume 1036, Page 111 of the deed records of said county and state said tract being more particularly described by metes and bounds as follows, to wit: For the PLACE OF BEGINNING, the intersection of the south line of East Lucas and the west line of Concord Road as established by a deed to the City of -Beaumont and recorded in Volume 1052, Page 143 of the deed records of said county and state, said point being the Northern most cor- ner of the herein described tract of land; THENCE South 53054' East, 20.0 feet along the west line of Concord Road to a point for corner; THENCE South 82°33' West, 28.99 feet to a point for corner in the South line of East Lucas; THENCE North 390 East, 20.O feet along the south line of East Lucas to the PLACE OF BE- GINNING of the herein described tract of land; CONTAINING 199.74 square feet of land more or less. Provided, however, there is excluded from said estate to be condemned and reserved to the owners thereof all of the oil, gas and sulphur beneath said land; and provided further that the rights of access, ingress and egress to or from the said Concord and East Lucas Streets of the remaining premises of defendants,are not to be condemned. PASSED BY THE CITY COUNCIL this the ojojO day of 1974. �� interest therein, Proceedings in Eminent Domain to acquire fee title, for said purpose, in and to the following described par- cel of land situated in Beaumont, Jefferson County, Texas, to wit: Tract #1 BEING a 1032.90 square foot tract of land situated in Lot 62, Block 6 ofFrench Heights Subdivision to the City of Beaumont, and being out of that cer- tain 0.932 acre tract as conveyed by a deed recorded in Volume 1703, Page 467 of the Deed Records of Jef- ferson County, Texas, the herein described tract being more particularly described by metes and bounds as follows, to wit: For a locative point a 1 inch pipe in con- crete at the southern most corner of the tract conveyed by a deed recorded En:Volume 1703, Page 467 of said County and State; THENCE North 40034' West, 144.0 feet to a point; THENCE North 00°45' West, 114.66 feet to the PLACE OF BEGINNING of the herein described tract; THENCE Continuing North 00°45' West, 15.64 feet to a point for corner in the South line of East Lucas as established by an instrument recorded in Volume 1052, Page 143 of the Deed Records of the aforementioned County and State; THENCE North 39000' East, 98.2 feet along said south line to a point for corner; THENCE South 40034' East, 10.17' to a point for corner; THENCE South 39000' West, 108.38 feet along a line parallel.to and 10 feet south of the south line of the East Lucas 60 foot right- of-way to the PLACE OF BEGINNING of the herein described tract of land; CONTAINING 1032.90 square feet of land more or less. Tract #2 A, Deed Records of Jefferson County, Texas, and being situated in Lot 63, Block 6, French Heights Sub- division to the City of Beaumont, Jefferson County, Texas, said Parcel being more particularly described by metes and bounds as follows, to wit: For -the PLACE OF BEGINNING, a point in the south line of East Lucas 60 foot wide street right-of-way said point being located North 39000' East, 8.30 feet from the point of in- tersection of the common line between Lots 62 and 63 and the south line of East Lucas; THENCE South 40034' East, 10.17 feet to a point for corner in the proposed south right- of-way line of East Lucas; THENCE along said proposed south line North 39°00' East, 15.66 feet to a point for corner; THENCE North 15019'20" East, 12.31 feet to a point for corner in" -the existing south line of East Lucas; THENCE South 39000' West, 21.0 feet along the existing south line of East Lucas to the PLACE OF BEGINNING of the herein described tract of land; CONTAINING 183.30 square feet of land more or less. Provided, however, there:is excluded from said estate. to be condemned and reserved to the owners thereof all of the oil, gas and sulphur beneath said land; and provided further that the rights of access, ingress and egress to or from the said East Lucas Street of the remaining premises of defendants are not to be condemned. 1974.
