R E' 'S' '0 'L' U` T' I 0 N BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the Federal Aid Highway Act of 1973 in Section 112 allocates, for the first time, planning funds to Metropolitan Planning Organi- zations to support urban transportation planning proces"s; and, WHEREAS, the Federal Highway Administration (in accordance with Section 112 of the Federal Aid Highway Act of 1973) and the Urban Mass Transportation Administration (in accordance with Section 9 of the Urban Mass Transportation Act of 1964, as amended) intend to fund the same designated metropolitan planning organization in each metro- politan area; and, WHEREAS, the Federal Aviation Administration intends to con- sider this agency for the receipt of airport system planning funds under Section 13 of the Airport and Airways Development Act of 1970; and, WHEREAS, the Governor of the State of Texas was charged by the Secretary of Transportation to select the agencies within this state to be designated as the -Metropolitan Planning Organization; and, ' WHEREAS, the Governor of the State of Texas has designated the South East Texas Regional Planning Commission as the Metropolitan Planning Organization for the South East Texas State Planning Region; and, ' WHEREAS, the Governor of the State of Texas also requires that the signatory parties to the Continuing Phase Agreement with the Texas Highway Department (under Section 134 of the Federal Aid HIghway Act of 1962, as amended) concur with the Governor's designation of the South East Texas Regional Planning Commission as the Metropolitan Planning Organization; and, WHEREAS, the City of Beaumont is a signatory party to the Con- NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the designation of the South East Texas Regional Planning Com- mission by the Governor of the State of Texas as the Metropolitan Planning Organization for the purposes of -.receiving Transportation planning funds under Section 112 of the Federal'Aid Highway Act of 1973 and in accordance with such guidelines as the Governor specifies is formally and officially approved; and, BE IT FURTHER RESOLVED that the South East Texas Regional Plan- ning Commission, thereby serving as the Metropolitan Planning Organi- zation, shall administer the ongoing transportation planning process, including the development of work program activities and the expendi- ture of transportation planning funds. The planning and administra- tive process shall .be determined and agreed upon by all signatory parties to the Continuing Phase Agreement; and, the Executive Director of the South East Texas Regional Planning Commission is directed to submit the required notification of this action to the Governor of -the State of Texas. The South East Texas Regional Planning Commission, thereby serving as the Metropolitan Planning Organization, shall administer the ongoing transportation plan- ning process, including the development of work program activities and the expenditure of transportation planning funds. The planning and administrative process shall be determined and agreed upon by all signatory parties to the Continuing Phase Agreement. 3.
