RESOLUTION
WHEREAS, the City Council of The City of Beaumont deems it
necessary to locate, construct, maintain, straighten, widen and extend
Washington Boulevard in The City of Beaumont, Jefferson County, Texas;
and,
WHEREAS, said City Council has found that public necessity requires
the location, construction, maintenance, straightening, widening and exten-
sion of said street on the hereinafter described property; and,
WHEREAS, said City Council deems it necessary to acquire the here-
inafter described interest in and to the hereinafter described property for said
location, construction, maintenance, straightening, widening and extension of
said street, and the said City Council has found and determined that the said
interest in and to the hereinafter described land is suited for such purposes and
that it is necessary to acquire same for said purposes; and,
WHEREAS, The City of Beaumont, through its duly authorized repre-
sentatives, has negotiated with the owners of the hereinafter described land
and has been unable to agree with the owners of such property as to the fair
cash value thereof and damages, if any, NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF BEAUMONT, TEXAS:
that Kenneth Wall, City Attorney, be, and he is hereby, authorized and directed
to file or cause to be filed against all owners of the hereinafter described prop-
erty, and claimants of interest therein, Proceedings in Eminent Domain to
acquire fee title, for said purpose, in and to the following described parcel of
land situated in Beaumont, Jefferson County, Texas, to -wit:
BEING a 1, 537, 5 square foot tract of land out of Lot 1, Block 107
of Cartwright Second Addition situated in the David Brown Survey,
Abstract 5, City of Beaumont, Jefferson County, Texas, as per
map or plat of said subdivision recorded in Volume 4, Page 9 of

FOR the PLACE OF BEGINNING, the intersection of the South
line of Rockwell Street and the existing East line of Fourth Street,
said point being the existing Northwest corner of Lot 1, Block 107
of said Cartwright Second Addition; .
THENCE South 000081 East, 150. 00 feet along the existing East
line of Fourth Street to a point for corner;
THENCE North 89052' East, 14. 00 feet to a point for corner;
THENCE North 02059'45" West, 150..19 feet along the proposed
East line of Fourth Street to a point for corner in the South line
of Rockwell Street;
THENCE South 89052' West, 6. 50 feet along the. South line of .
Rockwell Street to the'PLACE OF BEGINNING of the herein de-
scribed tract of land;
CONTAINING 1, 537. 5 square feet of land more or less.
PROVIDED, however, there is excluded from said estate to be con-
demned and reserved to the owners thereof all the oil, gas and sulfur beneath
said land; and provided further that the rights of access, ingress and egress
to and from the said Washington Boulevard of the remaining premises of de-
fendants are not to be condemned.
