WHEREAS, the City of Beaumont and Gulf Coast Industrial Con-
tractors, Inc. executed a certain contract for the paving of 23rd
Street as a participation.project at a total contract price of One
Hundred Twenty -Two Thousand and No/100 ($122,000.00) Dollars; and,
WHEREAS, the City of Beaumont was to pay one-third (1/3) of
the said construction cost and one-third of the engineering fee, said
engineering fee not to exceed ten per cent (10a) of the construction
cost; and,
WHEREAS, the property owner has previously deposited with the
City funds totaling Eighty -Nine Thousand Four Hundred Sixty -Six and
66/100 ($89,466.66) Dollars as its share in the participation project;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the, City of Beaumont hereby accepts the completion of the afore-
said contract in all particulars and further authorizes the final pay-
ment by the City of Beaumont of Eighteen Thousand One Hundred One and
No/100 ($18,101.00) Dollars to the contractor, Gulf Coast Industrial
Contractors, Inc. and Two Thousand Eight Hundred Sixty -Two and 20/100
($2,862.20) Dollars to Mr. Matt Racki, the Consulting Engineer, and
further authorizes the refund to the property owner of the amount of
Thirty -Five and 19/100 ($35.19) Dollars, which amount is equal to the
excess deposited by the property owner over the sum necessary to pay
the property owner's share of this participation project.
