..WHEREAS, the City Council of The City of Beaumont deems it
necessary to locate, construct, maintain, straighten, widen and
extend East Lavaca Street in The City of Beaumont, Jefferson
County., Texas _and,
WHEREAS, said City Council has found that public necessity
requires the location, construction, maintenance, straightening',.
widening and extension of said street on the hereinafter described
property; and,
WHEREAS, said City Council.deems,it necessary to acquire the
hereinafter described interest in and.t,o the hereinafter described
property for said location, cons'truct'ion, maintenance, straighten
ing, widening and .extension of' -said street, and the said City
Council has found and determined that the said interest in and to
the hereinafter.described land.is .suited for such purposes and that=
.it is.necessary to acquire same for said purposes; and,
WHEREAS, The City o:f Beaumon , through -its duly- au'thoriz'ed'
representatives, has negotiated with the owners of the hereinafter -
described land and has been unable to agree with the owners of'such
property as to the fair cash value thereof and damages, if any,':NOW,
THEREFORE,
BE IT RESOLVED BY,THE CITY COUNCIL `.
OF THE. CITY OF' BEAUMONT, TEXAS:
that Kenneth Wall, City Attorney.., be, and he is hereby, authorized
and directed to file or cause to be filed against all owners of

the hereinafter described property, and claimants of interest
therein, Proceedings in Eminent Domain to acquire fee title, for
said purpose, in and to the following described parcel of land
situated in Beaumont, Jefferson County, Texas, to -wit:
BEING a 3,285.8 square foot tract of land out of Lot,
No. 3 of the subdivision of a 24 acre tract of land
which was conveyed to Higgins Oil and Fuel Company by
deed recorded in Volume 101, page 579 of the Deed
Records of Jefferson County, Texas, and being out of
the J. W. Bullock League, said tract being more par-
ticularly described by metes and bounds as follows,
to -wit:
FOR A LOCATIVE POINT a concrete monument in the
Southwest corner of Lot 1 of the Lombardo Addition
to the City of Beaumont, Jefferson County, Texas,
and being in the original North line of East Lavaca;
THENCE North 89°18'15" West, 126.19 feet to a point
in the North line of East.Lavaca;
THENCE South 00041'45" West, 60 feet to a point
being the PLACE OF BEGINNING of the herein described
tract of land;
THENCE South 89018'15" East, 358.6 feet along the
South line of East Lavaca and the North line of Lot 3
of the Higgins Oil and Fuel Company subdivision to a
point for corner;
THENCE South 00013'45" West, 8.33 feet along the East
line of Lot No. 3 and the West line of Lot No. 2 of
said subdivision to a point for corner;
THENCE North 89034'15" West, 358.7 feet to a point
for corner in the West line of Lot No. 3;
THENCE North 000_43'4511 East, 10.0 feet along the West
line of Lot No. 3 to a point for corner and the PLACE
OF BEGINNING of the herein described tract of land;
CONTAINING 3,285.8 square feet' more or less.
Provided, however, there is excluded from said estate to be
condemned and reserved to the owners thereof all the oil, gas and
sulfur beneath said land; and provided further that the rights of
