R E S O L U T I O N
WHEREAS, on November 20, 1973, the City Council received bids for the
construction of sanitary sewer improvements as Federal Water Pollution Control
Administration Project No. WPC-TEX-975, Capital Improvements Project Nos.
II -SU -03, 12 -SU -04, Contracts It and lll, A -I; and,
WHEREAS, the instructions to bidders specified that bidders may tie
their bids for the purpose of providing a monetary deduction contingent upon
the City's acceptance of the bid on the tied contracts; and,
WHEREAS, the City Council is of the opinion that the bids submitted by
Holloway Sand & Gravel Company in the total amount of $9,301,494, which includes
a 12% discount on all separate unit prices, is the lowest and best bid for the
combined contracts; and,
WHEREAS, the City Council is of the opinion that the bids on all projects
should be awarded to Holloway Sand & Gravel Company contingent upon approval
by the Texas Water Quality Board, the Environmental Protection Agency, and fur-
ther tontingeny upon the authorization of the issuance of Certificates of Obli-
gation to finance the deficiency;
NOW, THEREFORE, BE IT RESOLVED.BY THE
CITY COUNCIL OF THE CITY OF BEAUMONTi
THAT the bids of Holloway Sand & Gravel Company for the construction of said
sanitary sewer improvements , including the 12% discount for awarding all bids
to Holloway Sand & Gravel Company, is hereby conditionally accepted; the accep-
tance of those bids is conditioned upon approval by the Texas Water Quality
Board, the Environmental Protection Agency, and further conditioned upon the
authorization by the City Council on December 18, 1973, of the issuance of Cer-
tificates of Obligation in a sufficient sum to finance any deficiencies in the
cost of the construction;
AND BE IT FURTHER RESOLVED that upon satisfaction of the conditions here-
tofore stated, the City Council will finally award the bids as stated and will
authorize the execution of a contract witft- Holloway Sand & Gravel Company for
the construction of said sanitary sewer improvements.
