HomeMy WebLinkAboutRES 24 CCCLLJ/gh/3/10/72 A R E S 0 L U T I 0 N WHEREAS, the City Council of the City of Beaumont, deems it necessary to locate, construct, maintain, straighten, widen and extend two streets, to -wit: Folsom Drive and Treadway in the,City of Beaumont, Jefferson County, Texas; and, WHEREAS, said City Council has found that public necessity requires the location, construction, maintenance, straightening, widening and extension of said streets on the hereinafter described property; and, WHEREAS, said City Council deems it necessary to acquire the hereinafter described interest in and to the here- inafter described property for said location, construction, maintenance, straightening, widening and extension of said streets, and the said City Council has found and determined that the said interest in and to the hereinafter described land is suitable for such purposes and that it is necessary to acquire same for said purpose; and, WHEREAS, the City of Beaumont, through its duly authorized representatives, has negotiated with the owners of the hereinafter described land and has been unable to agree with the owners of such property as to the fair cash value thereof and damages, if any, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT, TEXAS: That Thad Heartfield, City Attorney, be, and he is hereby, authorized and directed to file or cause to be filed against all owners of the hereinafter described property, and claimants of interest therein, proceedings in eminent domain to acquire fee title, for said purpose, in and to the following described parcel of land situated in Beaumont, Jefferson County, Texas, to -wit: Being a tract of land located in the F. Bigner Survey, Jefferson County, Texas, and being a portion of the tract awarded to E. L. Loper and wife by partition deed dated March 8, 1948, recorded in Volume 693, Page 96 of the Deed Records of Jefferson County, Texas, being more fully described as follows: Beginning at an iron stake for corner at the Northeast intersection of Folsom Drive (formerly called Gin Road) and Treadway Road; Thence North 40054'30" E 30 feet to iron stake for corner; Thence S 25°53' E 23.66 feet to iron stake for corner in the north line of Folsom Drive; Thence with the North line of Folsom Drive S 87020' W 30 feet to place of beginning, con- taining 0.015 acres of land more or less. Provided, however, there is excluded from said estate to be condemned and reserved to the owners thereof all the oil, gas and sulphur beneath said land; and provided further, that the rights of access and ingress and egress to and from the said Folsom Drive and Treadway to the remaining premises of defendants are not to be condemned.
