HomeMy WebLinkAboutRES 106 BBBLN/gh/l/6/72 A R E S 0 L U T I 0 N WHEREAS, pursuant to Article IX, Section 4 of the Primary Agreement - Beaumont Railroad Relocation - Grade Separation Project, and for the purpose of clarifying and amending said section, it is desirable and necessary that the City of Beaumont and the Southern Pacific Transportation Company enter into an agreement whereby the City will bargain, sell, release and forever quitclaim unto the Southern Pacific Transportation Company.all its right, title and interest in and to any and all rights -of City under said Article IX, Section 4 of said Primary Agreement, .in consideration for which the Southern Pacific-Tra.nsportation Company will grant, sell and .convey unto the City easements upon, across; along and over parcels of land out of the Noah Tevis League, Abstract 52, Beaumont, Jefferson County, Texas, and also out of Southern Pacific Transportation Company's 54.9 acre tract described in deed from Willie J. Robertson dated July 8, 1899 and recorded in Volume 28, Page 428, Deed Records of Jefferson County, Texas, said parcels of land connecting Mariposa Street to Orange Street, Ewing Street to Railroad Avenue, Janes Street to Neches Street, opening Archie Street into Magnolia Avenue, and the widening of Laurel Avenue from Orleans Street to west of Janes Street; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: That the Mayor be, and he is hereby authorized, to execute an agreement with the Southern Pacific Transportation Company, said agreement to transfer to the City certain easements for public road purposes over, along and across certain parcels of land presently owned by the Southern Pacific Transportation Company involved in the connection of Mariposa. Street to Orange Street, Ewing Street to Railroad Avenue, Janes Street to Neches Street, opening of Archie Street into Magnolia Avenue, and the widening of Laurel Avenue from Orleans Street to west of Janes Street; in consideration for said easements, the City will bargain, sell, release and forever quitclaim. unto the Southern Pacific Transportation Company all its right, title and interest in and to any and all rights of the City unto Article IX, Section 4 of the "Primary Agreement - Beaumont Railroad Relocation - Grade Separation Project"; and said easements tendered to the City of Beaumont be, and the same are hereby in all things accepted.
