HomeMy WebLinkAboutRES 104 BBBLJ/im/1/10/72 id -"Z "'S R E S O L U T I O N WHEREAS, the City Council of the City of Beaumont deems it necessary to locate and construct public facilities, to -wit, a police station, in Block Eleven (11) of the Original Townsite of Beaumont, in the City of Beaumont, Jefferson County, Texas; and, WHEREAS, said City Council has found that public necessity requires the location and construction of said police station on the hereinafter described property; and, WHEREAS, said City Council deems it necessary to acquire the hereinafter described interest in and to the hereinafter described property for said location and con- struction of said police station, and the said City Council has found and determined that the said interest in and to the hereinafter described land is suitable for such purposes and that it is necessary to acquire same for said purpose; and, WHEREAS, the City of Beaumont, through its duly authorized representatives, has negotiated with the owners of the hereinafter described land and has been unable to agree with the owners of such property as to the fair cash value thereof and damages, if any; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT, TEXAS: That Thad Heartfield, City Attorney, and Lavon L. Jones, Assistant City Attorney, be, and they are hereby, authorized and directed to file or cause to be filed against all owners of the hereinafter described property, and claimants of interest therein, Proceedings in Eminent Domain to acquire fee title, for said purpose, in and to the following described parcel of land situated in Beaumont. Jefferson County_ Texas_ LJ/im/1/10/72 1972. Being Lot No. Thirty-seven (37), the adjoining northeasterly sixty feet (60') of Lot No. Forty-eight (48), and the adjoining southeasterly thirty-one one -hundredths feet (.31') of Lot No. Forty-six (46), all in Block Eleven (11) of the Original Townsite of Beaumont, Jeffer- son County, Texas, according to the map or plat of said Original Townsite of Beaumont of record in the office of the County Clerk of Jefferson County, Texas., more fully described as follows: BEGINNING at the intersection of Main Street and Gilbert Street in the said City of Beaumont at the east corner of Block Eleven (11), for place of beginning, said point being the east corner of the tract described herein; THENCE southwesterly along the northwest boundary of Gilbert Street�a distance of sixty feet (60') to a point for the south corner of the tract described herein; THENCE northwesterly and at right angles to Gilbert Street along the boundary line dividing Lots No. Thirty-seven (37) and Thirty-eight (38), passing the northwesterly boundary of said lots at one hundred twenty feet (120') and continuing in a straight line through Lot No. Forty-eight (48), passing the northwest boundary of said Lot No. Forty-eight (48) at sixty feet (60'), and continuing an additional thirty-one one -hundredths feet (.31') to a point for corner, said point being the west corner of the tract described herein; THENCE northeasterly parallel to Gilbert Street sixty feet (60') to a point for corner, said point being the north corner of the tract herein described, and said point lying on the southwest boundary of Main Street; THENCE southeasterly along the northeasterly boundary of Block Eleven (11) and the south- westerly boundary of Main Street a distance of one hundred eighty and thirty-one one -hundredths feet (180.31') to the place of beginning, Subject to the right of the Kansas City Southern Railway Company to maintain its railroad track upon the southerly or southeasterly ten and one-h-alf feet (102') of said above described property.
