HomeMy WebLinkAboutRES 103 BBBLJ/im/1/10/72 /03 1046 R E S O L U T I O N WHEREAS, the City Council of the City of Beaumont deems it necessary to locate and construct public facilities, to -wit, a police station, in Block Eleven (11).of the Original Townsite of Beaumont, in the City of Beaumont, Jefferson County, Texas; and, WHEREAS, said City Council has found that public necessity requires the location and construction of said police station on the hereinafter described property; and, WHEREAS, said City Council deems it necessary to acquire the hereinafter described interest in and to the hereinafter described property for said location and con- struction of said police station, and the said City Council has found and determined that the said interest in and to the hereinafter described land is suitable for such purposes and that it is necessary to acquire same for said purpose; and, WHEREAS, the City of Beaumont, through its duly authorized representatives, has negotiated with the owners of the hereinafter described land and has been unable to' agree with the owners of such property as to the fair cash value thereof and damages, if any; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT, TEXAS: That Thad Heartfield, City Attorney, and Lavon L. Jones, Assistant City -Attorney, be-, and they are hereby, authorized and directed to file or cause to be filed against all owners of the hereinafter described property, and claimants of interest therein, Proceedings in Eminent Domain to acquire fee title, for said purpose, in and to the following described naYr-n1 r% -P 1 nr r7 of f, ,f - - A „- n--....,....._. 7_.CL_______ .,__.__-___ - 1972. Being -Lot Thirty-eight (38), the adjoining northeast fifteen feet (15°) of Lot Thirty-nine .(39), the adjoining seventy-five feet (75°) of Lot Forty-eight (48), the adjoining southeasterly thirty-one one -hundredths feet (.31') of Lot Forty-five (45), and a strip thirty-one one - hundredths feet (.31') in width and fifteen feet (15') in length off the southeast end of Lot Forty-four (44), all in Block Eleven (11) of the Original Townsite of Beaumont, Jefferson County, Texas, according to the map or plat of. said Original Townsite of Beaumont of record in the office of the County Clerk of Jefferson County, Texas, more fully described as follows: BEGINNING at the intersection of Pearl Street and Gilbert Street in the said City of Beaumont at .the south corner of said Block Eleven (11); THENCE northeasterly along the northwest boundary of Gilbert Street a distance of one hundred sixty five feet (165') to the point of beginning for, and the south corner of, the tract described herein; THENCE northwesterly and at right angles to Gilbert Street a distance of one hundred eighty and thirty-one one -hundredths feet (180.311), the same point being the west corner of the tract described herein; THENCE northeasterly parallel to Gilbert Street seventy-five feet (75 ) to a point for corner, the same point being the north corner of the tract described herein; THENCE southeasterly and at right angles to Gilbert Street one hundred eighty and thirty-one one -hundredths feet (180.31') to a point for corner in the northwest boundary line of Gilbert Street, the same point being the east corner of the tract described herein; THENCE southwesterly along the northwest boundary of Gilbert Street seventy-five feet (75') to the PLACE OF BEGINNING, Subject to the right of the Kansas City Southern Railway Company to maintain its railroad track upon the southerly or southeasterly ten and one- half feet (102') of said above described property.
