HomeMy WebLinkAboutRES 102 BBBLJ/im/1/10/72 - 7 R E S O L U T I O N WHEREAS, the City Council of the City of Beaumont deems it necessary to locate and construct public facilities, to -wit, a police station, in Block Eleven (11) of the Original Townsite of Beaumont, in the City of Beaumont, Jefferson County, Texas; and, WHEREAS, said City Council has found that public necessity requires the location and construction of said police station on the hereinafter described property; and, WHEREAS, said City Council deems it necessary to acquire the hereinafter described interest in and to the hereinafter described property for said location and con- struction of said police station, and the said City Council has found and determined that the said interest in and to the hereinafter described land is suitable for such purposes and that it is necessary to acquire same for said purpose; and, WHEREAS, the City of Beaumont, through its duly authorized representatives, has negotiated with the owners of the hereinafter described land and has been unable to agree with the owners of such property as to the fair cash value thereof and damages, if any; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT, TEXAS: That Thad Heartfield, City Attorney, and Lavon L. Jones, Assistant City Attorney, be, and they are hereby, authorized and directed to file or cause to be filed against all owners of the hereinafter described property, and claimants of interest therein, Proceedings in Eminent Domain to acquire fee title, for said purpose, in and to the following described .y parcel of land situated in Beaumont, Jefferson County, Texas, to -wit: Being Lot Forty-one (41), the adjoining south- westerly forty-seven feet (47') of Lot Forty (40), and the adjoining southwesterly twenty one -hundredths feet (.20') of Lot Forty-seven (47), all in Block Eleven (11) of the Original Townsite of Beaumont, Jefferson County, Texas, according to the map or plat of said Original Townsite of Beaumont of record in the office of the County Clerk of Jefferson"County, Texas, more fully described as follows: BEGINNING at the intersection of Pearl Street and Gilbert Street in the said City of Beaumont at the south corner of said Block Eleven (11), the same point being the south corner of the Sims tract herein described and the south corner of said Lot Forty-one (41); THENCE northwesterly along the northeast boundary line of Pearl Street and the southwest boundary line of Lot Forty-one (41) one hundred twenty and twenty one -hundredths feet (120.20') to a point for corner, the same point being at right angles to the west corner of a two story brick building on said Sims tract and the south corner of a two story brick building on an adjoining tract belonging to Norman Szafir; THENCE northeasterly parallel to Gilbert Street, passing at twenty one -hundredths feet (.20') the west corner of a building on the Sims tract and the south corner of a building on the Szafir tract, and continuing along the northwest wall of the building on the Sims tract and the southeast wall of the building on the Szafir tract, passing the north corner of the building on the Sims tract at eighty and thirty-five one -hundredths feet (80.35') and continuing to a re-entrant corner at one hundred seven feet (107'), the same point being the north corner of the tract herein described; THENCE southeasterly parallel to Pearl Street a distance of one hundred twenty and twenty one - hundredths feet (120.20') to a point for corner, said point being in the northwest boundary line of Gilbert Street and the same point being the east corner of said tract herein described; THENCE s-outhwesterly along the northwest boundary line of�Gilbert Street a distance of one hundred seven feet (107') to the PLACE OF BEGINNING, Subject to the right of the Kansas City Southern Railway Company to maintain its railroad track upon the following described portion of the hereinabove described property: Beginning at the east corner of the hereinabove 1972. m Thence southwesterly along the northwesterly boundary of Gilbert Street a distance of seven- teen feet (17') for corner; Thence northwesterly at right angle to Gilbert Street a distance of ten and one-half feet (102') for the west corner of the portion herein described; Thence north- easterly and parallel to Gilbert Street a distance of seventeen feet (17') to a point for the north corner of the portion herein described; Thence southeasterly and at right angles to Gilbert Street a distance of ten and one-half feet (102') to the place of beginning.
