HomeMy WebLinkAboutRES 101 BBBs LJ/im/1/10/72 -/0/ la,6& R E S O L U T I O N WHEREAS, the City Council of the City of Beaumont deems it necessary to locate and construct public facilities, to -wit, a police station, in Block Eleven (11) of the Original Townsite of'B'eaumon t,'in' the 'City of Beaumont, Jefferson County, Texas; and, WHEREAS, said City Council has found that public necessity requires the location and construction of said police station on the hereinafter described property; and, WHEREAS, said City Council deems it necessary to acquire the hereinafter described interest in and to the hereinafter described property for said location and con- struction of said police station, and the said City Council has found and determined that the said interest in and to the hereinafter described land is suitable for such purposes and that it is necessary to acquire same for said purpose; and, WHEREAS, the City of Beaumont, through its duly authorized representatives, has negotiated with the owners of the hereinafter described land and has been unable to agree with the owners of such property as to the fair cash value thereof and damages, if any; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT, TEXAS: That Thad Heartfield, City'Attorney, and Lavon L. Jones, Assistant City Attorney, be, and they are hereby, authorized and .direc ted tofile or cause to be filed against all owners of the hereinafter described property, and claimants of interest therein, Proceedings in Eminent Domain to acquire fee title, for said purpose, in and to the following described parcel of land situated in Beaumont, Jefferson County, Texas, to -wit: Being Lot Forty-seven (47), the southwest forty-five and seven one -hundredths feet (45.07') of Lot Thirty-nine (39), and the northeast thirteen and one tenth feet (13.1') of Lot Forty (40), all in Block Eleven (11) of the Original Townsite of Beaumont, Jeffer- son County, Texas, according to the map or plat of said Original Townsite of Beaumont of record in the office of the County Clerk of Jefferson County, Texas, more fully described as follows: BEGINNING at the intersection of Pearl Street and Gilbert Street in the said City of Beaumont at the south corner of said Block Eleven (11), the same point being the south corner of Lot Forty-one (41); THENCE northwesterly along the northeast boundary line of Pearl Street and the southwest boundary line of Lot Forty-one (41) a distance of one hundred twenty feet (120') for corner, said point being the west corner of Lot Forty-one (41) and the south corner of Lot Forty-seven (47) and the beginning point of the tract herein described; THENCE northeasterly along the boundary line between Lots Forty-one (41) and Forty-seven (47), passing the north corner of Lot Forty- one (41) and the west corner of Lot Forty (40) at sixty feet (60'), and continuing along the boundary line of Lot Forty-seven (47) and Lot Forty (40) a distance of one hundred six and nine tenths feet (106.9') for corner, said point being the southwest wall of a two story brick building on the tract herein described; THENCE southeasterly along the southwest wall of the building on the tract herein described, at one hundred seven and fifteen one -hundredths feet (107.15') passing a corner of said build- ing, continuing to a point for corner at one hundred twenty feet (120') in the northwest boundary line of Gilbert Street; THENCE northeasterly along the northwest boundary of Gilbert Street fiftyei0t and seventeen one -hundredths feet (58.17 ) to a point for corner; - THENCE northwesterly and at right angles to Gilbert Street, passing the most easterly corner of the building on the tract herein described at twelve.and eighty one -hundredths feet (12.80') and continuing now along the northeast wall of the building on the tract herein described passing,the most northerly corner of said build- ing at one hundred seventy nine and sixty nine one -hundredths feet (179.69') and continuing to (180ijt for corner at one hundred eighty feet THENCE southwesterly parallel to Gilbert Street and with the northwest boundary of Lot Forty- eight (48), at fifteen and seven one -hundredths feet (15.07') passing the west corner of Lot Forty—eight (48) and the north corner of Lot Forty-seven (47), continuing along the north- west boundary of Lot Forty-seven (47) to a point for corner in the northeast boundary of Pearl Street at one hundred sixty-five and seven one -hundredths feet (165.07'), the same point being the west corner of Lot Forty-seven (47); THENCE southeasterly along the northeast boundary of Pearl Street and the southwest boundary of Lot Forty-seven (47) a distance of sixty feet (60') to the place of beginning, Subject to the right of the Kansas City Southern Railway Company to maintain its railroad track upon the southerly or southeasterly ten and one- half feet (102') of said above described property.
