A R E S 0 L U T I 0 N
WHEREAS, the City of Beaumont and the Southern Pacific
Company, the Atchison,. Topeka and Santa Fe Railway Company,
the Kansas City Southern Railway Company, and the Missouri
Pacific Railroad Company, hereinafter called "Ra.ilroads",
entered into a letter agreement dated April 30, 1969, whereby
the City agreed to establish a reserve from which to pay certain
judgments and litigation expenses arising under the Primary
Agreement between the City and the Railroads; and,
WHEREAS, pursuant to the terms of said letter agree-
ment, the City is to return one-half of the sum remaining in
said reserve fund to the Railroads after payment of said
judgments and litigation expenses; and,
WHEREAS, all of said judgments and litigation expenses
have been paid and there is a balance remaining in said reserve
fund of $58,184.29;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COUNCIL OF THE CITY OF BEAUMONT:
That the City Controller be; and he is hereby authorized, to
pay to the aforementioned Railroads the sum of $29,092.15.
