HomeMy WebLinkAboutRES 54 BBBLLJ / im/ 11 / 15 / 7 1 5/ 1310 16 A R E S 0 L U T I 0 N WHEREAS, damage to the Mariposa Street Viaduct at the Southern Pacific railroad tracks has resulted in a situation of grave urgency for the citizens of Beaumont in commuting between the downtown area and south Beaumont; and, WHEREAS, by letter dated November 12, 1971, and by oral agreement, the Southern Pacific Land Company has agreed to convey to the 01ty of Beaumont an easement for the con- struction of;a'ftemporary street across the Southern Pacific tracks),-dntingent on the City's agreement to pay for certain -specified work on three existing track crossings at an estimated cost of $3,680; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: That the City of Beaumont shall pay for the cost of removing, replacing, and resurfacing three track crossings in accordance with .a certain estimate of cost provided by the Office of Chief Engineer of Southern Pacific dated November 8, 1971, and attached to the aforementioned letter of November 12, 1971, from the Southern Pacific Land Company, bearing a total cost estimate of $3,680; provided, however, that the contribution of the City of Beaumont to the said project shall in no event exceed $4,000; and, BE IT FURTHER RESOLVED: That the City of Beaumont will cement stabilize a section of the subbase 12' x 54' x 12" thick under each of the aforementioned three existing tracks and apply asphalt across these existing tracks in accordance with Southern Pacific specifications; and, BE IT FURTHER RESOLVED: That the City of Beaumont does hereby accept a license Avenue across Southern Pacific property, being an easement of 1.280 acres, more or less, in accordance with that certain drawing prepared by the Office of Chief Engineer, Houston, Texas, of the Southern Pacific Transportation Company, more particularly identified as Drawing No. 71-1462, and dated November 11, 1971, which drawing is incorporated by reference herein as fully and completely as though it were a part of this resolution; and, BE IT FURTHER RESOLVED: That the Public Works Department is hereby authorized to begin construction of said temporary street; and, BE IT FURTHER RESOLVED: That the great burden placed upon other streets in the City of Beaumont necessary for the commutation between downtown Beaumont and south Beaumont, resulting in increased traffic on other streets, and the corresponding burden on the citizenry and businesses of the City of Beaumont creates an emergency and urgent public necessity making imperative the immediate passage of this resolution without posting notice thereof for three days preceding the day of the meeting, as required by Article 6252-17(f) of the Texas Civil Statutes, except in the event of an emergency or urgent public necessity.
