A RE SOLUTION
s ..
WHEREAS, on September 28, 1971, the City received bids
for the Waste Treatment Plant Improvements; and,
WHEREAS, Mar -Len, Inc. submitted a bid in the sum of
$498,880..00--for-the completion of said Waste Treatment Plant
Improvements; and,
WHEREAS, Charles R. Haile Associates, Inc., Consulting
Engineer for the City for the subject improvement, has re-
commended that the contract be awarded to Mar -Len, Inc.; and,
WHEREAS, the acceptance of this bid and awarding of
the contract must be made subject to approval by both the Texas
Water Quality Board and the Environmental Protection Agency
of the United States Government to comply with Federal in-
structions as a predicate to obtaining Federal funds for said
project; and,
WHEREAS, the City Council is of the opinion that the
bid submitted by Mar -Len, Inc. is the lowest and best bid and
should be accepted and a contract entered into with Mar -Len,
Inc. for said Waste Treatment Plant Improvements;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF BEAUMONT:
That the contract be awarded to Mar -Len, Inc. subject to approval
by- the- Water �Quality..Board. and the Environmental Protection
Agency of the United States Government, and, subject to approval
by said agency, that..the City Manager be, and he is hereby,
authorized to execute on behalf of the City of Beaumont the
contract with Mar -Len, Inc. for the Waste Treatment Plant

Improvements for the sum of $498,880.00; be it further resolved,
that if either the Texas Water Quality Board or the Environ-
mental Protection Agency of the United States Government should
refuse, for any reason, to approve this bid, this acceptance
of said bid and authorization to execute the contract in pursuance
thereof shall be null and void; and the City Clerk is hereby
authorized to attest to said contract and to affix the Seal of
the City of Beaumont thereto.
PASSED by the City Council this the 12th.day of
October, 1971.
