HomeMy WebLinkAboutRES 83 AAAe 29 AAA R E S O L U T I O N WHEREAS, the City's compactor suffered damage to its automatic transmission housing, which damage could not have been foreseen, and which necessitated immediate repair in order to keep the unit in operation; and, WHEREAS,- the operation of said compactor is -essential to the City's landfill operation, and therefore essential to protect the health of the citizens of this City; and, WHEREAS, the repair..work on the compactor was accomplished on an emergency basis by Stewart and Stevenson, Inc., the only factory authorized repair dealer in the State of Texas, the bill for which emergency repair was $3,512.34; and, WHEREAS, Article 2368a, Texas Civil Statutes, authorizes payments without competitive bidding in order to preserve or protect the health of the citizens of a city, or in the event of unfore- seen damage to public property, machinery, or equipment; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT, TEXAS: That, by the authority of the aforesaid Article 2368a, V.A.T.S., the City Manager be, and he is hereby, authorized to pay Stewart and Stevenson, Inc. the sum of $3,512.34 for said emergency repairs. to the City's compactor; and the City Clerk is hereby authorized to attest to same and to affix the seal of the City of Beaumont thereto.
