HomeMy WebLinkAboutRES 13 AAA/'3 AAA A RESOLUTION WHEREAS, the City Council of The City of Beaumont, deems it to be necessary to locate, construct, maintain, straighten, widen and extend a street, to -wit: Crow Road, in the City of Beaumont, Jefferson County, Texas, between Folsom Drive and Eastex Freeway; and, WHEREAS, said City Council has found that public necessity requires the location, construction, maintenance, straightening, widening, and extension of said street on the hereafter described property; and, WHEREAS, said City Council deems it necessary to acquire the hereinafter described interest in and to the hereafter described property for said location, construction, maintenance, straightening, widening and extension of said street, and the said City Council has found and determined that the said interest in and to the here- after described land is suitable for such purposes and that it is necessary to acquire same for said purpose; and, WHEREAS, The City of Beaumont, through its duly authorized representatives, has negotiated with the owners of the hereinafter described land and has been unable to -agree with the owners of such property as to the fair cash value thereof and damages, if any; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT, TEXAS: That Thad Heartfield, City Attorney, be and he is hereby authorized and directed to file or cause to be filed against all owners of the hereinafter described property, and claimants of interest therein, proceedings in eminent domain to acquire fee title, for said purpose, ALL THUT CERTAIN tract or parcel of land out of the F. B 4igner Survey, Abstract leo.. 1, Beaumont, Jefferson County, Texas, and being a part of Lot 5 of the subdivision of Mrs. V. A. Collier Estate, 1.1 p of which appears in Map records, Volume 3, Page 119, Jefferson County, Texas and said tract being out of that certain tract of land conveyed to Redeemer Lutheran Church of Beaumont, Texas by C. J. Patt it to and wife Amanda Pattillo, deed of o hrich appears in Volume 1217, Page 351 of the Deed records of Jefferson County, said herein described parcel beim more fully bounded and described as follows BEGINNING at a 5/8" iron rod in the east line of Crow Road, said rod marks the northwest comer of said Redeemer laatheran Church tract and the southwest corn -or of the First Church of Cod tract described in deed from C. J. Fattillo et al, deed record in Volume 1422, Page 381 of the Beed Records of Jefferson County, Texas; 1111ERCE along the first course and along the co= on boundary between the Redeemer: Latheran Church tract and the First Church of God tract South Eighty-nine degrees Thirty-five minutes East (S 89`35' E) for a distance of 22.29 feet to a 1/244 iron rod for corner; THEIME South One degree Thirty-five minutes East (S 01'35' E) for a distance of 350.20 feet to €a 1/2" rod for corner in the north lime of the E. E. Rhodes et ux tract described in deed from Charlie Wrenn et ups recorded in Volume 404, Page 380 Deed Records of Jefferson County, Texas; TZHIMCE with the north lire of said E. H. Rhodes at ux tract Forth Eighty-nine degrees Thirty- ttxa minutes West (N 89°32' 10 for a distance of 2..52 feet to a 1/2" iron rod in the east line of Crow Road for corner; TF.7 SCE North One degree forty-two minutes-- - — `Thirty seconds X%k-.st (N 0142' 3041 W) along the east line of Crow Road for a distance of 350.21 feet to the PLACE OF BEGIIdi MNG CONTAINING IN AREA 0.176 Acres of lased more or less. 3_a�_./9f�l. 3), Provided, however, there is excluded from said estate to be condemned all the oil, gas and sulphur which can be removed from beneath said land without any right whatever remaining to the owners of such oil, gas and sulphur of ingress or egress to or from the surface of said land for the purpose of exploring,chveloping, drilling, or mining of the same; and provided further, that the rights of access and ingress and egress to and from the said Crow Road of the remaining premises of defendants are not to be condemned.
