HomeMy WebLinkAboutRES 59 ZZ10/5/70 1p • 1 AGENDA ITEM NO. 10 ,5-9 ZZ A R E S O L U T I O N WHEREAS, on the 31st day of July, 1957, The City of Beaumont recovered judgment against JAKE DIFATTO in the sum of $201.14, plus interest thereon at the rate of six per cent (6%) per .annum from the date thereof, -together -with costs of court, said judgment being in Cause No. 32629, SOUTH PARK INDEPENDENT SCHOOL DISTRICT vs. JAKE DIFATTO, in the 136th District Court of Jefferson County, Texas; and, WHEREAS, the entire amount of the judgment adjudged in favor of The City of Beaumont, together with interest and costs, has been tendered and paid to The City of Beaumont, and the City Council is of the opinion that a release of the said judgment and all liens acquired by virtue of said judgment should be executed; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: That the City Manager be, and he is hereby, authorized, for and in consideration of the payment of said judgment; with interest and costs, to execute and deliver an instrument to JAKE DIFATTO, their heirs and assigns, releasing any rights and interest acquired by The City of Beaumont by virtue of said above mentioned judgment; and the City Clerk is hereby authorized to attest to said instru- ment and to affix the Seal of The City of Beaumont thereto. h PASSED by the City Council this the day of October, A. T • C:ir,y JTG: cmo A.ttachmont, THE STATE OF TEXAS X COUNTY OF JEFFERSON X WHEREAS, on the 31st day of July, 1957, judgment was rendered against JAKE DIFATTO, in the 136th District Court of Jefferson County, Texas, in Cause -No. 32629, styled SOUTH PARK INDEPENDENT SCHOOL DISTRICT VS. JAKE DIFATTO, in favor of the City of Beaumont, Jefferson County, Texas, for the sum of $201.14, plus interest thereon at six per cent (6%) per annum from the above mentioned date. The above mentioned sum, together with all costs of court, was adjudged as a lien against the pieces,of laxed described in said judgment as the SOUTH HALF OF LOT NUMBER FIFTEEN, BLOCK NUMBER EIGHT (S.12 of Lot 15, Block 8) of the FOURTH STREET ACRES ADDITION to the City of Beaumont, Jefferson County, Texas, according to the map or plat of said addition of record in the office of the County Clerk of Jefferson County, Texas; and, WHEREAS, said judgment and interest, together with all costs thereon, has been paid and satisfied in full to the Intervenor; The City of Beaumont. NOW, TEEREFORE, KNOW ALL MEN BY THESE PRESENTS; That the City -of Beaumont, acting herein by and through its duly authorized City Manager, in consideration of the premises and of the full pay- ment of said judgment, interest and costs, the receipt of which is hereby acknowledged, has this day, and does by these'-pfesents, CANCEL, RELEASE and DISCHARGE unto the said JAKE DIFATTO, his heirs, executors and administrators all right, title, interest and estate in and to said judgment and judgment liens, which the City said judgment and judgment liens, which the City of Beaumont r, has or may have herein, fully paid and satisfied, and said judgment liens released and discharged to all intents and purposes.
