A R E S 0 L U T I O.N
WHEREAS, pursuant to Resolution dated April 14, 1970,
The City of Beaumont did, on April 3, 1970, enter into a con-
tract with Austin Paving -Company for hot mix asphalt overlay
on certain streets within the City of Beaumont, at a total
contract price, based upon estimated quantity of $103,274.44;
and,
WHEREAS, said contract .provides that in case the actual
quantity of any major item should become as much as 20% more
than, or 20% less than the estimated or contemplated quantity
for such items, then either party to this Agreement, upon demand,
shall be entitled to a revised consideration upon the portion of
the work above or below 20% of the estimated quantity; and,
WHEREAS, The City of Beaumont has requested an extension
of the afotdsaid cohttact in the sum of $19,953.28, which said
extension is for hot mix asphalt overlay of Laurel from Magnolia
to 11th Street;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF BEAUMONT:
That the City Manager be and he is hereby authorized to execute
on behalf of The City of Beaumont the Supplemental Agreement for
changes and alterations as aforesaid; and the'City Clerk is
hereby authorized to attest to said Supplemental Agreement and
to affix the Seal of The City of Beaumont thereto._
