BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF BEAUMONT, TEXAS:
That the'City Manager be and he is hereby authorized tp execute
on behalf of the City of Beaumont an agreement with M. L.
Lefler, Jr., Frank. Dover, Oscar Eldridge, W. .Cavett Brown and
C. A. Kohler, terminating and canceling Paragraph V of a cer-
tain existing agreement between the said M. L. Lefler., Jr.,
Frank Dover, Oscar Eldridge, W. Cavett Brown and C. A. Kohler,
and the City of Beaumont, which agreement had been executed
September 5, 1969, and which was ratified.by the City Council
on September 16, 196 9; and the City Clerk is hereby authorized
to attest to same and to affix the Seal of The City of Beau-
mont-thereto.

Dear,Sit:
In compliance with instructions from the Mayor and
tbq City Council, the City of Beaumont agrees to furnish
A'11labor,,-material, eq-.-iipment, and .all other items nec-
essary :to:completion of water and sewer lines on Mercantile
Street from Virginia Avenue to Cardinal Drive at no expense
to the.jandowners . Upon completion, the City agrees to
accept,:.for•permanent maintenance Mercantile Street, and its
sewe'r.'and water lines.
This letter is written in conjunction of a settle
ment,f a, .,pone-fide--ds-pute, and is in no way indicative
_._ ._.,.._ change' of policy of the City of Beaumont relative to
coiripletion --of' streets'in a subdivision.
