WHEREAS, an agreement was reached on April 30, 1969,
between The City of Beaumont and Southern Pacific Company,
The Atchison, Topeka and Santa Fe Railway Company, The Kansas
City Southern Railway Company, and The Missouri Pacific
Railroad Company, collectively, hereinafter called "Carriers",
relating to Phase I of the Beaumont Railroad Relocation and
Grade Separation Program,, and to proposed payments to and
from Carriers in settlement of said Phase I, all as more
particularly set forth in;said agreement which is incorporated
herein by reference; and
WHEREAS, pursuant'to the aforesaid agreement, The
City of Beaumont and the "Carriers" agreed that settlement
among them should occur on or about the 20th day of
November, 1969, in accordance with said agreement and as
stated on the attachment hereto captioned "Railroad Relocation
Program Analysis of Proposal for Payments to and from Railroads
for Phase I Settlement, October 22, 1969"; and,
WHEREAS, the City Council is of the opinion that The
City of Beaumont and The!Carriers should commence settlement
under the terms of said agreement; and,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE,CITY OF BEAUMONT:
That the City Manager be,; and he is hereby authorized and
directed to make separate payments to and in exchange for
payments received from Carriers in accordance with said
agreement of April 30, 1969, and in the amounts stated in the
aforesaid attachment.
PASSED by the City Council this the 18th day of
November, 1969.
