HomeMy WebLinkAboutRES 3 YYA R E S 0 L U T I 0 N WHEREAS, in conjunction with the design on the part of The City of Beaumont to acquire property for the West End Feeder — Right -of -Way, the Great Southwest Wholesale Fish & Oyster Company, Inc., has tendered an offer to convey to The City of Beaumont for the consideration of Two and 38/100 ($2.38) Dollars per square foot, the following -described property, to -wit: Being a tract of land out of and a part of Lots 7, 8, 9, 10, 11, and 12 in Block 23 of the Jarrette Addition to the City of Beaumont, Texas, as recorded in Volume 3, Page 175 of the map records of Jefferson County, Texas and being more particularly described as follows: BEGINNING at a 3/4 inch iron pipe marking the Northeast corner of said Lot 7, Block 23, Jarrette Addition and lying also in the South line of Calder Avenue a 7-0 foot street in the City of Beaumont; THENCE South with the East line of said Lot 7, 15.49 feet to a concrete monument for corner; THENCE Southwesterly with the arc of.a 700 foot radius curve.to the left a distance of 152.13 feet to a concrete monument for corner, said monument lying also in the West line of said Lot 12 and the East line of 18th Street a 60 foot street in the City of Beaumont; THENCE North with the said East line of 18th Street and the West line of Lot 12, 39.01 feet to a 3/4 inch pipe for corner, said corner being also the Northwest corner of said Lot 12 and the point of intersection of the said South line of Calder Avenue and the East line of 18th Street; THENCE East with the said South line of Calder Avenue 150.00 feet to the PLACE OF BEGINNING and.containing 3,669.35 square feet of land. WHEREAS, the Great Southwest Wholesale Fish & Oyster Company, Inc., has proposed, as a condition of said conveyance, that The City of Beaumont lease back the property so conveyed to said company for an annual rental equaling 82% -of the total purchase price paid by The City of Beaumont. The term of said lease to be for a period of time until The City of Beaumont actually begins construction and does, in fact, utilize the above-mentioned property for that purpose; but in no event WHEREAS, the City Council has considered the purpose of said conveyance and lease agreement and is of the opinion that they are necessary and desirable, and that they should be executed. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF'BEAUMONT: That the City Manager be, and he is hereby, authorized to execute on behalf of the City of Beaumont a lease agreement with the Great Southwest Wholesale Fish and Oyster Company, Inc., allowing said company to use the above described property for an annual rental equaling 82% of the total purchase price paid by The City of Beaumont for a period of time until The City of Beaumont actually begins construction and does, in fact, utilize said property; that the City Manager be, and he is hereby, authorized to purchase said property on behalf of The City of Beaumont from the Great Southwest Fish and Oyster Company, Inc. for a total consideration of $2.38 per square foot; and the City Clerk is hereby authorized to attest to said lease agree- ment and to affix the seal of The City of Beaumont thereto.
