PRO?'ERTY, LEVYING AND ASSESSING AS A TAX UPON.THE TRACKS OF THE EASTERN
TEXAS BIECTRIC CGRP AiVY ALL THE COST OF PAVI1AG- BETWEEN? AND TWO (2) FEET
ON .EACH SIDE OF THE TRACKS, AN; RAILS OF SAID CaKPANY WHERE SAID TRACKS
OCCUPY THOSE PORTIONS OF THE ABOVE STREETS; AND DECLARING SAID TAA A
LIEN UPON SAID PROPERTY AND A PERSONAL DEBT UPON THE OWNER OR OWNERS THERE-
OF AND PRUVIDIN;G A TIRE WHEN SAID TAX SHALL BECOME DUE AND PAYABLE,
PROVIDING FOR TEE COLLECTION OF SANTE AND ALL COSTS INCURRED II COLLECTION
OF SIME IF NOT PAID AT THE TIME IT BECON33 DUE AND T ABLE; AND PROVIDING
THE RATE OF INTEREST SAID TAX SHALL BEAR FRONT THE, TIME IT BECOMES DUE UN-
TIL PAID; LED DECLARING' AN E ERGENCY.
Whereas, pursuant to the requirements of sub -division (h) of
Section 68, of the Charter of the ,pity of heaumont, the Qity commission
of the City of $eaumont caused to be published for the time and in the
manner required therafor by the City :charter, az notice of a, resolution
of said Qommission, passed heretofore on the 5th Day of July &Q. 1927
ordering a hearing to he given to the persons, firms, corporations and
estates, their agents or attorneys, owning property abutting on Royal.
Street from the West-- Side of- Pennsylvania Avenue to- the -mast Side of
Avenue F; and Foch Street from the West line of Avenue F to the fast line
of the Right of Way of the Texas and New Orleans Railroad Company, and
to the owners of --Railroads and Street Railroads on said Streets; and
calling upon all persons interested in said matter to appear and show
cause in conformity with the pxvisi.ons of the Charter above referred to,
whT the assessment in said notice should not be made against said property
and against the ownebs thereof, which hearing was to be held in the
Council Chamber of the City Hall of the My of ieaumont q Texas at 4 Or
Clock p. M. _ on the 26th., Day of July A. D. 1927; and
Whereas, a full and fair hearing in conformity with the Chartex
and the law in such cases having been had in conformity with said notice,
of the Qommission having inquired into and determined all facts necessary
to the adjudication of all special benefits accruing to such owners by
means of such impr ovemen ta, said hearing having been duly closed; and
It appearing that the assessment as proposed in the above men-
tioned
entioned resolution passed on the 5th Day of July A. 0. 1927 Lith the ex-
ceptions heveinafter noted are in all respects fair and `equitable, ar-A
that there will be a full and adacluate and Special Benefit to the abut-
ting property and the owners thereof by reason of the proposed pavement
and improvement in excess of the amount assessed against the abutting
property and the respective ,owners thereof.

SECTION 1.

between the West . line of Pennsylvania Avenue and the East line of Avenue 5 -
and loch 4treet, between the West line of Avenue F and. the Zast line of the
Right of Way of the Texas and New orleans hailroad Company, as a tax, two
thirds (2/3) of the cost of paving and gutter and incidental drainage of
said Areets, (exclusive of the whole cost between curb lines of improving
said Meets at thest inter -sections with other Streets and .Alleys) and
all costs of curbing said Royal Street between the West line of Pennsylvania
Avenue and the East line of Avenue and Foch Street between. the West line
of svenae p and the fast line of the Right of Way of the Te as and New Or-
leans Railroad Company, and against the tracks of the'

Company where occupying said Royal street between the West line of Penn-
sylvania Avenue and the East line of Avenue P, and Poch Street .between
the West line of Avenue P and the East line of the -dight_ _os Way of the Texas
and Slew Orlears Railroad Company, and against said ;astern .1ewas U ectrin''C
Company, all the cost of paving between and two (2) feet da each``o "Ke
tracks and rails of said Company. N.
The lot, lots, parts of lots, blocks or tracts of land on which
said tax is levied and assessed is: hereinaftel described together with
the numbeT of front feet on such lot, lots, pang of lots , blocks or tracts
of land, the name of names of the owmax or- owners thereof and the propor-
tionate amount ,of the cost of said paving and guttei , and the cost of said
curbing to be borne and paid for by such owner or owners as shown by the
statement prepared by the City Engineer of the City of Bed1mont , whidt said
$mcunOis hereby levied and assessed as a tax upon such lots, parts of
lots, blocks or tracts of land as shown to -wit;

SECTION 2.
That said amounts so levied and assessed shall become due and
payable upon the co.ipletion of the paving upon the portions of said Streets
upon which said lots, lot, parts. of lots, blocks or tractsof land., front
and abutt, anal the amount of the tax hereby lati,ed and. assessed together
with the cost of collecting and interest at. Seven (7%) per cent per annum
from the date same is collectable, until paid is hereby declared a lien
against said lot, lots, parts of lots, blocks or tracts of land, superior to
all other liens, claims, or titles except .City, Oounty and State taxes, and
constitute a personal charge or claim against the owner or owners of said/ -
lots, parts of lots, blocks or tracts of land.
SECTION 3.
All tie cost of grading and paving those portions. of =royal
Street between the uVest line of Pennsylvania Avenue and the 3ast Zine of
,Avenue F; and Foch Street between the West line of Avenue F and the East
line of the dight of Way of the Texas and New Orleans railroad Company
as are occupied between the rails of the tracks of the F,a.sterr_ Texas
Electric �%ompany and a space twenty four(24) inches beyond the outer
edge o�- the rails of the tracks of said Oompany located on said Streets
shall he borneby the said Eastern Texas Electric Company, and all such
costs of said impro7ements are hereby assessed against the said Eastern
Texas Electarc 'company and shall be collected as other assessments levied
under this ordinance, provided such work -s hall be done in accordance with
the City Ordinances regulating the construction of railroads in the
Streets of the Qity of Beaumont and the paving of s=uch streets traversed
by the same.
SECTION 4.
The fact t -hat the portions of the above- named Streets as indicated
are in bad condition and jeopardize the safety of the people traveling khere-
on creates an emergency ah.d an imperative public necessity, necessitating
the suspension of the rule reauiritig ordinances. to be read on three (a)
several days before their passage, said rule is therefore hereby_ suspended
and this Ordinance shall take effect and be in full force axed effect from
and after its passage and publication.
