HomeMy WebLinkAboutORD 72-F, ; �1 =fit AN ORDINANCE ENTITLED AN ORDINANCE LEVYING AND ASSESSING AS A TAX UPON THE 1.0 LOTS, PARTS OF LOTS, BLOCKS, OR TRACTS OF LAND WHEI4 NOT DIVIDED INTO LOTS OR BLOCKS, FRONTING OR ABUTTING ON WALL JSTR.EET FROM THE WEST SIDE OF PARK STREET TO THE EAST SIDE OF RAILROAD AVENUE AND TRIN STREET FROM THE SOUTH SIDE OF FORSYTHE STREET TO THE �_. v TH SIDE OF COLLEGE STREET, TWO THIRDS (2/3) OF THE COST OF THE PAVING AND GUTTER AND INCIDENTAL DRAINAGE AND ALL THE COST OF CURBING SAID WALL STREET FROM THE WEST SIDE OF PARK STREET TO THE EAST SIDE OF RAILROAD AVENUE AND TRINITY STREET FROld THE SOUTH SIDE OF FORSYTHE STREET TO THE NORTH SIDE OF COLLEGE STREET APPORTIONABLE TO THE HEREINAFTER REFERRED TO PROPERTY; -AND DE— CLARING SAID TAX A LIEN UPON SAID PROPERTY AND A PERSONAL DEBT UPON THE CfWNER OR OWNERS THEREOF AND PROVIDING A T II:"E WHEN SAID TAX SHALL BECOME DUE AND PAYABLE, PROVIDING FOR THE COLLECTION OF SAME AND ALL COST INCURRED IN COLLECTION OF SAME IF NOT PAID AT THE TIME IT BECOMES DUE AND PAYABLE; AND PROVIDING THE RATE OF INTEREST SAID TAX SHALL BEAR FROM THE TIME IT BECOMES DUE UNTIL PAID AND DECLARING AN EMERGENCY. WHEREAS, pursuant to the requirements of Sub—division (h) of Section 68, of the Charter of the City of Beaumont, the City Com— mission of the Gity of Beaumont caused to be published for the time and in the manner required therefor by the City Charter, a no.,tice of the Resolution of said Commission, passed on the 19th day of April, A.D. 1927, ordering a hearing to be given to the persons, firms, cor— porttions and estates, their agents or attorneys owning property abutt— ing on Wall Street from the west side of Park Street to the east side of Railroad Avenue and Trinity Street from the south side of Forsythe Street to the north side of College Street, and calling upon all per— sons interested in said matter to appear and show cuase, in conform— ity with the provisions of the Charter above referred to, why the as— sessment in said notice should not be made against said property and against the owners thereof, which hearing was to be held in the Coun— cil Chamber of the CityHall of Beaumont, Texas, at 4:00 o'clock P.M. on the 21st day of June, A. D. 1927; and WHEREAS, a full and fair hearing in conformity with the Char— ter and law in such cases having been had in conformity with sand notice and the Commission having inquired into and. determined all facts nec— essary to the adjudication of all special benefits accruing to such owners by means of such improvements, and said hearing having been duly closed; and It appearing that the assessment as proposed in the above mentioned resolution passed on the 19th day of April, A. D. 1927 with the exceptions hereinafter noted, are in all respects fair and equit— able and that there will be a full and adequate and special benefit to the abutting property and the owners thereof from and by reason of the propsed pavement and improvement in excess of the amount as— sessed against the abutting property and the respective owners thereof. NOVI, THEREFORE, BE IT ORDAINED BY THE CITY COIiiMISSION OF THE CITY OF BEAUMONT: SECTION I. That there is hereby assessed against the several owners of i and Trinity Street from the south side of Forsythe Street to the north side. of College Street, as a tax two thirds ( 2/3) of the cost of paving and gutter and incidental drainage of said Streets, ex— clusive of the whole cost between curb lines of improving said Streets at their intersections with other streets and alleys, and all the cost of curbing said Wall Street from the west side of Park Street to the East side of Railroad Avenue and Trinity Street from the south side of For— sythe to the north side of College Street. The lot, lots, parts of lots, blocks or tracts of land on which said tax is levied and assessed is hereinafter described together with the number of front feet on such lot, lots, parts of 18ts, OW blocks or tracts of land, the name or names of the owner or owners thereof and the proportionate amount of the cost of said paving and gutter, and the cost of said curbing to be borne and paid for by such owner or owners as shown by the statement prepared by the City Engineer of the City of Beaumont, which said amount is hereby levidd:and assessed o as a tax upon such Alots, parts of lots, blocks or tracts of land as shown, to—wit: SECTION 2. That said amounts so levied and assessed shall become due and payable upon the completion of the paving upon the portion of said Streets upon which said lot, lots, parts of lots, blocks or tracts of land, front and abutt; and the amount of the tax hereby levied and assessed, together with the cost of collecting and in-- terest at seven (7%) per cent per annum from.the date same is collect— able until paid is hereby declared alien against said lot, lots, parts of lots, blocks or tracts of land, superior to all other liens, claims, or titles except City,. County and Statd taxes, and constitute a personal charge or claim against the owner or owners of saidl6ts, parts of lots, blocks or tracts of land. SECTION 3. The fact that the portions of the above names Streets as in.— dica.ted are in. bad -condition and jeopardize the safety of the people travelling thereon creates an emergency and an imperative public nec— essity, necessitating the suspension of the rule requiring ordinances to be read on three (3) several days before their passage, said rule i s, therefore , hereby suspended and this Ordinance shall take effect and be in full force and effect from and after its passage and publication.
