Home My WebLink AboutORD 70-FAN ORDINANCE GRANTING to the Beaumont Wharf and Terminal Company, its successors and assigns, the right and privilege to construct and maintain one certain spur track with point of switch on the north branch of the Beaumont Wharf and Terminal Company, beginning 135.5 sleet west of the west line of Grand Avenue and running thence in an eastward direction across Grand Avenue to Lot Six (6) in Block One (1) of the Kirby Addition to the City of Beaumont, with the right to maintain and operate its trains and cars thereover for.a period to expire at the same time with its franchise for the main track of the Beaumont Wharf and Terminal Company in Long Avenue, and prescribing the conditions to be fulfilled before said or- dinance shall go into effect and the time limit for the removal, - of said track and prescribing the conditions thereof,.-.. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BEAUMlIONT : SECTION I. That the Beaumont Wharf and Terminal Company, its- suc-c essors and assigns are hereby granted the right and privilege to construct and maintain, at -its own expense, a single, standard guage railroad track on Long -Avenue with point of switch on the north branch of the Beaumont -Wharf and Terminal Company beginning 135.5 feet west of the west line of Grand Avenue and running thence in an eastward direction on a 99 301' curve to the right and a 150 curve to the left across Grand -Avenue to Lot Six (6) in Block One (1) of the Kirby Ad- dition to the City of Beaumont, in all a distance of 196 feet, more or less, as shown on blue print attached hereto, it being understood and agreed that the track and siding is laid as an industrial track for the purpose of reaching commercial and industrial enterprises located along the right-of-way on which said track is authorized to be laid. SECTION 2. The Grantee, its successors and assigns shall have the right to operate trains, engines and cars over said track and siding when done so to further the interests for which this grant is given, as stated in the latter portion of Section I hereof°. SECTION 3. That the said Beaumont Wharf and Terminal G"ompany shall be required, at its own expense, to construct and maintain suitable, ditches and culverts for the purpose of properly draining said street and to construct and maintain, at its own expense, good and sufficient crossings at the intersectionsof all cross streetscrossed by its_sa.id railroad tracks with easy approaches thereto and on crossings -on paved streets to construct permanent crossings in ac— cordance with glue print attached hereto and under the direction of the City Engineer. SECTION 4. The Grant herein given is for a single track only and shall be laid under the direction of the City Engineer of the City of Beaumont and should a dispute over said construction arise, the Grantee, its successors and assigns, hereby,agres to refrain from doing said work until the matter of dispute has been settled by the City Commission of the City of Beaumont. SECTION 5. This ordinance is passed subject to all the terms and provisions of the Charter of the City of Beaumont. SECTION. 6. The foregoing rights and privileges are especially grant— ed upon the express condition that the said Grantee, its successors :or_ assigns,, shall, within thirty ( 30 ) days after the passage and approval by tthe. Mayor of this franchise, acting through its proper officer, file with the City c its written acceptance of this ordinance and upon further condition that the tracto be con— structed hereunder shall be completed within days from the ' passage hereof and upon the failure of the Grantee,its successors or assigns, to file its acceptance as provided herein, then this franchise shall be null and void and become of no further force nor Affaat_ r e SECTION 7. Gentlemen: - Jefferson Drug Company proposes to erecta wholesale warehouse on Long Avenue, and to handle carload shipments to and from the building Railway Company has been requested to construct a 321 -root spur track out of the North Branch of the B4T&T main track at Beaumont. In this connection it will be necessary that we se - cure a franchise from the City of Beaumont granting us permis- sion to construct the track in Long Avenue and across Grand. Avenue.
